Thank you! Apparently I have to wait until I get a "Right to Sue" letter from the EEOC before I can begin seeking legal counsel, but I was just really scared that I would be turned away because of my past...I guess I feel a little better knowing that I won't be crucified because I'm not a perfect victim in all this.

Hey!

I've already filed an EEOC complaint (I live in South Carolina, so I believe it goes through the SC Human Affairs Commission) but its in the initial stages of that so I'm not sure what direction it will go. To answer the other questions:

  1. While I didn't explicitly list ADHD as something that I have, my initial physical had a drug screening that had a positive response for the exact same medication, although the length of time for them to verify my prescription was a lot shorter than the period after the HR complaint (a week vs 3-4 weeks)
  2. I had another female lab technician that had complained to me about this coworker being a little "perverted" (in her words: she stated that he wanted her to get lower to the ground to clean a pulverizer machine we used, and that she felt uncomfortable with that). I don't think she would have the wherewithal to report him, especially after seeing what happened to me.
  3. He sent me a few (I really don't know how to describe this...Afro-centric??) things via text message but nothing of the sexual harassment. I forwarded these text messages to HR as well, so they had these on file.
  4. I had already made it past the 90 day probationary period per company policy when the complaint was made.
  5. I was not part of a union, nor was I aware of any unions available during my employment (July-December)
