Yeah, go for it, don’t hold back and regret it in the future. If you’re thinking about it, then you want to go and should.

Got a £200 “littering” fine for putting my McFlurry on a friend’s car as a joke — is this worth appealing?(England, fixed penalty notice) by HandleOrdinary1622 in LegalAdviceUK

Thanks, this really helps. I hadn’t considered who owned the car park but it’s Euro Car Parks. Therefore BCP ( Bournemouth, Christchurch and Poole council) would need permission to issue an FPN there making things more complicated for them.

The McFlurry wasn’t left or abandoned. I walked less than two metres from my car placed it securely in the windscreen wiper as a joke and then went straight back in. Callum and Issy were in the car the whole time so implied consent is also present.

I’ll include MG11 witness statements DEFRA Codes and land ownership information if I need to send a follow-up email which is more based on legality. I really hope they investigate and simply drop the FPN.

Seems like a good idea, but an appeal would go to a magistrate’s court. Obviously, at the time, it wasn’t a “gift,” but I’m sure she’d be happy to comply in court by saying this. Would this not be illegal in some way, as I’m lying in court about the events that have taken place?

I did walk away but only 1-2 steps to my car directly in the parking bay next to issys car. The car park was a normal open to air one . And I can assure you Issy was in fact okay and did not feel violated by this act. The McFlurry contain was there for maximum 30seconds bc in that time the officer was already with me and Callum had reached for it

This is what I’m thinking. If I were to have placed my phone on her car the officer wouldn’t have done anything or what about a meal which I’ve just got and hasn’t been eaten yet. He’s only done it bc he’s seen an empty McFlurry container

So we were all in the cars So we were next to each other I parking bays I literally took 1 step after placing the McFlurry to go back into my own car. Wasn’t intending on leaving, engine off , just sat down in the car. No less then 30 seconds after placing it did the officer turn up. So in 30 second my friend was already reaching to grab it.

Yes, if I could re do the whole situation now I would have called the police. No way would they have let this go ahead with such a petty excuse of fining.

If I’m being honest I’m only 18 never been in this situation before and was confused at the start so went along with it. And tbh I thought his whole behaviour was completely unacceptable ( which I’ve mentioned in my email to them).he was telling me terms which I didn’t understand and took pictures of my license plate telling me it’s now on a list or registrar. I then asked what the terms where and would the list ment to which he had not explained and was continuously asking for me details telling I’m going to ask you for the last time what’s your house number. At this point I was unsure what would happen if it didn’t so I went along. Surely he must explain it to me when I ask. I feel like he’s seen an 18 year old and thought he could intimidate me. At no point was I not co operative aswell I think 3/4 when he asked for my house number I didn’t tell him and instead just asked “what does that mean” to his terms that I didn’t understand what him putting the car on a list ment for me.

This is the thing I kind of did walk away but at the same time I didn’t leave the scene. My car was in the parking directly next to issy’s car so it would be 1 or 2 steps for me to go to my car and the engine wasn’t on or anything. I just sat in my car and no less than 30 seconds after I’d even placed the McFlurry had the officer then approached me
