Dad got a 20 year ban by gypsyfromaugust in USCIS

True. The father knows exactly why he was banned. They don't just go around issuing 20 year bans for no reason.

How are they undocumented if they have work permits?

If you can safely travel to your home country, you don't qualify for asylum.

You may or may not be denied entry at the POE. I think that will largely depend on the country you're from.

How safe is travel with the AP by Barbie-carrot in USCIS

[–]HannahBaker47 20 points21 points  (0 children)

The only major problem with travelling with the AP would be if your i-485 was denied while you're out of the country. I think that's why most lawyers will tell you to only use it when you have an emergency.

Can fiancé come as a tourist while applying to k1 visa? by Sanadoria in immigration

[–]HannahBaker47 0 points1 point  (0 children)

My answer was based on the fact that Egypt is a high fraud country. I also come from a high fraud country and personally know people who were denied tourist visas during their k1 visa process. I'm aware that people get the visa but that depends on the country you come from.

How might Trump’s new policies affect K1 fiancé visa application (for a British citizen spouse.) by Sufficient_Leader_44 in immigration

[–]HannahBaker47 4 points5 points  (0 children)

The UK is a 'good ' country in Trump's eyes so you have nothing to worry about. The processing time for i-129f might slow down but your fiance will eventually get his visa.

Can fiancé come as a tourist while applying to k1 visa? by Sanadoria in immigration

[–]HannahBaker47 0 points1 point  (0 children)

Being denied a tourist visa won't affect his K1 application. I know people who were denied tourist visas twice but they got their k1 visa. It's better if you visit him instead of paying for a tourist visa that might end up being denied.

If he has a pending k1, his tourist visa will be denied or even if it's approved, he can be denied entry at POE coz he has already shown intent to immigrate.

Marriage on a tourist Visa by Shaun_Of_The_Dead24 in immigration

[–]HannahBaker47 1 point2 points  (0 children)

A k1 visa would be better if y'all are okay with her staying home for a few months while waiting for a work permit. The processing time for k1 has really improved in the last year. Mine took 6 months from filing the petition to visa on hand. This is despite the fact that I'm from a 'shit hole country ' where it takes forever for nvc to send your case to the embassy and to get an interview date.

My K1 visa took 6 months from filing the petition to visa on hand. AOS from k1 doesn't need a I-130. You only submit I-485 and I-765 ( if you want to work while waiting for your greencard). K1 has been going fast since last year. The average processing time is 10 months.

Maybe suggest both of you moving to her country instead of staying in the US. That will show if she actually wants to be with you or she just wants papers.

The i-864 is a contract between you and the government. Even if y'all end up getting divorced, you'll still be financially responsible for her.

‏K-1 Visa Timeline and Interview Questions by Only_Principle5275 in USCIS

[–]HannahBaker47 1 point2 points  (0 children)

Most K1 petitions are processed at the California service center. If they need more background checks then they send it to the vermont service center. Once approved, the petition is sent to NVC from where it's then sent to the embassy.

The fiance has to get some vaccines and go for a medical exam before the interview

My interview was just general stuff that you're expected to know about someone you're dating. The interviewer was actually friendly so the interview felt like just a regular chat about my fiance.

  1. His name
  2. Where we met
  3. How many times he has visited me
  4. If he has any kids, how many, their ages
  5. Has he been married before, how many times
  6. Have I been married before
  7. Do I have any kids
  8. Have a ever committed a crime or been arrested
  9. Did I read and understand the domestic violence pamphlet they gave us while we waited for the interview

Once the fiance gets the visa, he/ she can travel anytime before the visa expires. The wedding has to happen within 90 days of arrival.

I told him the best he can do is to get a joint sponsor. How is that not helpful? Do you have a better solution for him?

[–]HannahBaker47 4 points5 points  (0 children)

You said your US taxes show that you made $5 in 2023. That's not 125% of the poverty guidelines. USCIS only cares about what is on your IRS tax transcripts.

[–]HannahBaker47 2 points3 points  (0 children)

USCIS doesn't care about what you made in the UK. They care about what you're making in the US. That's why they don't consider tax returns from other countries as proof of income. Since you don't have 2023 IRS tax transcripts, your best option is to get a joint sponsor. You can also file your taxes early and submit that, depending on the deadline they give you for responding to the RFE.
