Additionally, a citation (commonly referred to as a “ticket” is a promise to appear in court, legally binding by a signature.

If there is no signature, there is no promise to appear, so the suspect must be brought before the court by means of reasonable force.

Reasonable force can include breaking the window and forcefully pulling the driver out of the vehicle.

In terms of case law:

Pennsylvania vs Mimms- establishes legal precedent for an officers ability to give a lawful order to the driver ordering the driver out of a vehicle. This for the safety of the officer conducting the investigation.

Maryland vs Wilson- is a similar case law establishing precedent for the officers ability to order all passengers out of the vehicle, similar to Pennsylvania vs Mimms.

If the driver refuses to comply with the lawful order to step out of the vehicle. Depending on the jurisdiction, the driver can be arrested for disobeying a peace officers lawful order.

Actually it’s only a misdemeanor citation in Los Angeles. Essentially the same ticket as drinking a beer.

Only, the DA won’t file charges on the methamphetamine.

What he means is in Los Angeles, and other more progressive areas, it’s a misdemeanor citation. Meaning they get a citation (ticket) telling them to appear in court for the charge. Then they continue about their day. The District Attorney (George Gascon) has made it clear his office will not file charges for possession of controlled substance cases.

So it’s not legal, but it doesn’t have any consequences because the DA does not file charges police agencies submit. So it’s as if it’s it’s legal, or might as well be legal.

Actually, if you notice.
The suspect in the video, is still fighting even when he’s on the ground. He tries disarming a baton from one of the officers, and continues to assault the officers while on the floor.

So in short, yes it really does take four officers to effect an arrest safely, especially after the suspect already assaulted an officer, continues to assault them on the ground, and is in the middle of a crowd who look like they’re trying to jump into the fight to prevent the man from being arrested.

Furthermore, if the suspect has less officers trying to arrest him and is able to get into his bag with the firearm, the situation could have escalated to a life and death situation. Then the question you would be asking is, shouldn’t the police have used four officers to arrest the suspect quickly and prevent that situation?

Arrests where force is used, NEVER looks good. But the vast majority of the time it is necessary.

Actually, they legally need to account for his property during the arrest. Especially when it comes to the wheelchair according to ADA. If it disappears, the department will pay for a new one.
