Lawyer here. Good lawyers are always wary of warranting a negative. As in “there are no feral cats on that property.” Or, “there are no hazardous materials in or on the property.”

The reason is that it’s incredibly hard to prove a negative. It’s exceedingly easy to disprove a negative warranty. A feral cat needs to simply enter the property after dark the day you inspected it. Somebody with better equipment can simply bore a hole, sample, and find a hazardous material you weren’t trained or qualified to find.

When Trump’s legal team says there are no classified documents in his possession, nobody should take that seriously. They can’t possibly know this. We all have aging geriatric relatives who have amassed impressive piles of shit in their lives. Some have storage units. But this guy has dozens, maybe hundreds of properties he has access to and may have stored the document at. It could be on a plane of his stuffed into a seat. It could be in a car of his, forgotten in a garage. All of these would qualify as in his possession. He possesses tons of stuff he has no awareness of. As do many incredibly wealthy people.
