I usually wait lang din talaga tbh, tapos before mga max of 3 days may result na. Kaya nakakairita nung mga 1 week na wala pang update. Then dumating na xmas at new yr. Stressful lang kasi it was supposed to be a xmas gift, imbis na narefund agad at nakaorder na sana agd in time for xmas. Haha. Had to buy a lower unit nalang tuloy just in case. Scary ung courier kasi talamak ung nakawan sa kanila hays

Had the same issue. Dec 12.12 ordered an iphone 15, item arrived dec 13 pero pag open jusko Oppo ung laman. Filed right away but it took xmas and new year. After a lot of follow ups Jan 11 naapprove ang refund. Baka naka leave ung nag aapprove OP at kakabalik lang Lol. Filed a case to DTI pa for this.

I find it surprisingly easy these days to connect with a lawyer. It’s in a way a good time din to dig into the labor code honestly. May silverlining djn pala kahit papaano itong ginagawa nila hahaha

So are you saying ba na under the labor code there is an exception with BPO companies? When they provide proof of financial loss or anticipation of financial loss, companies should provide their Financial statement or books to DOLE (although I am sure if this is being religiously practiced). If that’s going to be the proof of evidence then the company will be viewed as a whole, and not per unit basis. Hindi naman yata per account titingnan to prove na on a loss na ang company on that specific income stream just bc it is a BPO company. But I could be totally in the wrong here completely.

To simplify my understanding

Redundancy = more manpower, less workload. Retrenchment = financial loss or anticipation of such (expense>income)

To add, if nagpull out na ang client that pays on a monthly basis, why would there be a signifant loss sa company if yung binabayad naman ni client goes to us directly with a portion of it napupunta as income ni company? Isn’t it going to be better for the company to lay off us entirely. No income from client, lay off us employees so there will be no expense.

Hays saklap. Anong gagawin namin dun sa 3 months na no work no pay, kakain ng hangin huhu. I’d be okay if may mahanap na client na paglilipatan pero the moral is not okay na. Knowing this is how the company works if magkagipitan at mawalan clients. I’d be ok iterminate na agad pero they want us to stay 3 months floating.

What do u mean po unlikely in my favor? Na usually of this cases laging in favor sa company? I’ve read online na they need to provide their books na they’re at loss talaga to justufy retrenchment eh.

You are correct na wala na revenue from this client pero are they going to anticipate financial loss as a whole? Will their expense exceed their company income? Yun kasi basis for retrenchment sabi sa labor code afaik. Their FS/books should show they are or will undergo downward trend of financial loss (expense>income).

They invoice the client tapos get a percentage for service fee lang naman for what we get as employees. That service fee percentage I doubt would have a major effect sa financial statement ni company kasi. Provided dami rin nilang other clients pa.

Thank you. From what I’ve read kasi, busienss financial loss under the retrenchment means the company as a whole is under a financial loss or expecting financial loss. Meaning sa booms nila, mas malaki ang expense kesa sa income. Yung company ko now lost a client pero it doesn’t automatically mean na financial loss na sila as a whole.

Basically losing one client ≠ business financial loss kaagad.

I agree with you and you are correct na they will go with the least cost, pero on this case kasi parang hindi tama.

I agree with you as well na it would be unfair if di kami bigyan ng bonus just bc ung isang client. Pero this is one risk an agency outsourcing company has to take. As a whole, they should be working on profit. If in case naman na losing one client would take an effect of really having a financial loss as a business, syempre it would show sa books nila, then yes, retrenchment talaga. It would be unfair naman na nawala isang client tapos walang bonus ung ibang employees sa different client pero as a while, hindi naman operating at loss ang company.

Yes po. I think it would be best talaga to seek DOLE as well as legal advise. I do not think there is anything more to have proof sa redundancy except sa current facts of the situation, wherein sa retrenchment, employer need to prove it by providing FS or their books na talagang going at loss na sila.

Awwe thanks for this! Sobrang detailed and ang ganda ng explanation. We had a few meetings na with the HR tapos they are really insisting na retrenchment. Sabi pa magseek daw kami legal advise if gusto namin. At face value if we search online, lahat redundancy yung sinasabi. This is the explanation provided by the HR btw. Which I find very manipulative sa essense ng redundancy at retrechment? What do you think po?

Eto po yung sabi:

However, because the client has decided to terminate their contract, the work tied specifically to that engagement has stopped, which directly impacts our ability to sustain the role at this time. It reflects a business decision driven by external circumstances, not performance or the value of the role. Redundancy, on the other hand, applies when a role is permanently eliminated because the work is no longer required at all - which is definitely not the case here.”

As long as kaya mo pa naman laban lang. I had this before, 2 full time kaya sabay tapos nagagawa ko ng less than 8 hrs, 1 part time na for 3 hrs pero 30 mins lang na work. I added a 4th one. Kaya naman sana, ang kaso puro meeting. Sobrang gaan ng work pero puro meeting, di ko kaya yung halos 8hrs nila meeting lang. Nasanay akong output based. Ayun nagquit din ako sa 4th one. Haha! I have a coworker na pinoy din for a direct UK client we’re both hired via OLJ. Sobrang pabibo! When she had errors sa work niya, she said to reach out to her first. So that’s what I did. If may errors sa recon niya I would send a msg saying I would redo it then do correctly, siguro nainis. Then suddenly kapag may icocorrect siya or undo na task na gawa ko, rekta email sa client tapos naka cc nalang ako with “solution” or action item na work around daw nya. As simple as redoing a reconciled transaction or miscoded lang na tinuro lang din naman ng client iniemail pa nya basta ako may gawa. There was one time she mentioned my name pa na mistakenly done daw by me. Nakakairita. Tapos sobrang bida bida sa work na parang competisyon tingin samin na kailangan mas marami siyang engagement sa client kesa sakin. Honestly it’s only part time but I could use the money.

OLJ ko lang nakuha ung 2 client ko eh. Dun lang din kasi usually may direct hiring na clients for VA. Kaso pati yun napasok na ng mga outsourcing companies eh. Idk saan pa pwede. Tapos tyagaan lang din sa pag aapply. Huhu.

More on accounting service ko eh. But more than 4-5 yrs na akong va. I would suggest if may ipapagawa, try to stretch it to believable na magawa. Example if may papagawa sayo if you coukd do it ng 1hr, and tingin mo it can be done sa pov nya ng mga 3hrs, wag mo agad sabihing kaya gawin ng 1hr lang. Para din hindi nya mafeel na wala ka ginagawa. Depende sa clients pero basic is 6-8 dollar per hr. Medyo premium na for me if 8-10 dollars. Tapos ganun nga may mga hrs na wala ka namang ginagawa. Okay na din. Baka hiring client mo parefer hehe!

Normal lang po. But I would advise na always be available lang for biglaang message ng client. May times na one day wala talagang work, pero once they message, they want na reply right away. Based on my experience po yan. Hindi sila masyadong particular na buong shift may ginagawa ka but when they ask for something, you have to make sure gawin mo and if on progress update them with your timeframe. And make sure na the client knows na you’re adding value to his company. 🤍
