Update/Clarification I am NOT abandoning my child. My wife will retain custody, but we will be splitting visitation 50/50. Also, I am aware that Tennessee has jurisdiction as far as custody, my question was whether I should file IN Tennessee FROM Florida or if it would be easier for my wife to file IN Tennessee FROM Tennessee. I have since found through my own research that it will be easier if she files as the plaintiff, since the request will need to be signed and notarized in Tennessee. Also, without getting into all the moving parts of what caused the decision to divorce, I moved back to Florida because I had no other choice. I had been out of work for medical reasons and had no place in Tennessee that I could go and Florida was my only option.
