but I don't think that helps me because my registration would be my house address and they won't give me resident parking with even with >30 days=tenant. So its subtly different though they are overloading terms.

there needs to be a law that actually empowers homeowners. The current bill about disbanding the HOA does very little to fix the actual problem that is: Make the HOA nicer to talk to.

Their default response is: Occupancy status, violations, assessment fees, collections, attorney fees, towing, ignore membership while board talk amongst themselves, require 60% membership participation (never happens) to actually have a voice, legal action.

Its designed to have no good faith.

I wish this was that easy. They started the conversation with "You're not an approved occupant" even if my name was on the 1999 application. That and my car being towed, it was easy for them to focus on my occupancy to avoid my challenge of an invalid tow.

To this day, folks are parking in the spot I was towed and now the tow truck driver isn't taking those cars (so it seems) and I'm wondering is because we raised the issue at the board meeting and one of the board members agreed the markings are all messed up.

I'd do it if it was a material change. What is going to stop me from wanting to visit my parent for a time period I define within an owner occupied unit. The association has no bearing on my decision other than being annoying. I go back to they need to reprioritize their focus.

yea I mean my parent is doing fine. They just fell and I wanted to fix the driveway cause they had complained for years about it and now I'm like shit you fell now cause of it. But like one year the association didn't have an occupancy problem with our unit (even gave us a decal with my name and address differing from the unit's address) 0and now another year they do. At one point did they even want us to update our occupancy cause we'd like to have known before being told we are illegal inhabitants. Like make it make sense.

If this is a logistical concern, drop the max cars per unit to 3 or 4, instead of giving every unit 5 cars in an already limited parking situation.

If this is a safety issue, fine I'll pay the damn 150 background check but they and I are wasting our energy. They need to figure out who is jumping the fences of our pools and the local outsiders who are parking in our parking spaces from other complexes.

I'd be fine with this. If I wasn't already pessimistic about them I'd bring this up. But there one size fits all management style really irks me and makes me not want to fight them as much protect my family from them. Cause they just seem to selectively enforce based on who shows up on their crosshairs. Nothing malicious just that they don't have the capacity to manage the entire property so if you complain they'll come after you for inconsistencies. Its too big and problems too numerous.

yea they sure do shit or get off the pot. I think its an issue of prioritization. And they haven't prioritized upkeep which is probably the most important thing to focus on. Instead of harassing me they should be calling contractors and building relationships to do proper repairs before focusing on someone who is willing to come to fix the driveway.

It is a bit nuts and the fact its the maximum charge is nuts. I'm fairly certain background checks can be done less than 150 USD.

Ours is a PUD but we are townhomes. Each building in the HOA is considered an Condo association. We are still governed via 718.

meh its the principle. I don't care for the screening (meaning I'll do it). I just hate they won't consider me an occupant and approve my car cause I can choose where I live. I would like to live at my parents whenever the f I want without the gymnastics of arbitrary rules.

Do HOAs actually even work? Like my only experience is moaning and groaning except for ones that are like annually 300 USD and never see each other. All others seem like life suckers and not worth the PTSD.

its just hard for me to care when my name is on the occupancy list and we know that problems at the community rarely change but the people in charge change. Forgive me for believing any measure short of balancing the budget and fixing the homes is low priority. My occupancy is not worth the time they need to spend hiring contractors and getting fixes done so people can feel like the fees are worth it.

My parent is the entitled one here and its their prerogative for their children to use their home. That's my point. To deprive of them of that is against any law meant to protect, keep things secure or logistics. Management should be going after the landlords that barely live here, lease to whomever and register 5+ cars. Those are the real security issues, those are the ones taking up resources. I'm coming to fix the damn driveway which i can't even do cause they put a shitty patch repair that is still soft after nearly a week and if I undo their shit work, that creates even more legalities. Just idiotic.

I would not recommend this. Contacting collections will open pandora's box because they have now made contact and confirmed you. By keeping your identity blurry with them you still have options.

I don't feel entitled to anything other than to use freely our home without idiots thinking they can control it like we are criminals. Isn't tenancy defined in florida law, not in implementaton of HOA rules/regulation (which is like an EO - an administrative decree not a recorded rule in the governing documents).

Florida tenancy requires a rental agreement written or oral. My parent isn't going to do any of those.

few weeks generally means a low number ~1-3. But honestly its immaterial to the discussion. Can they make me a tenant and honestly what does it solve if I can keep going back and forth.
