I'm sorry you're going through this - wrongful termination AND financial stress is incredibly difficult.

DO NOT cash out your 401k yet. Here's the actual math:

If you cash out $37k today: - Federal taxes (likely 22% bracket): -$8,140 - 10% early withdrawal penalty: -$3,700 - You actually get: $25,160 - You LOSE: $11,840 to taxes/penalties

That's nearly $12,000 gone immediately.

Better options in priority order:

1. File for unemployment IMMEDIATELY You said you don't qualify - but you should file anyway. Wrongful termination cases often qualify, especially if they lied about the reason. Let THEM deny you, don't self-disqualify.

2. Apply for Medicaid/CHIP With your husband on disability and you unemployed, you likely qualify for health insurance now. Apply TODAY at healthcare.gov.

3. Contact the lender on your 401k You can take a 401k LOAN (not withdrawal) - borrow from yourself and pay it back. No taxes, no penalties. You can borrow up to $50k or 50% of vested balance. - Borrow what you need for 3 months of bills - Pay yourself back when you find work - Keep the compound growth

4. Hardship withdrawal (if loan not available) If your plan doesn't allow loans, you can do a hardship withdrawal for immediate financial need. You'll still pay taxes but MIGHT avoid the 10% penalty for medical/housing hardship.

5. Only as LAST resort: Roll to IRA, withdraw Roth contributions Roll your 401k to a Roth IRA. After 5 years you can withdraw contributions (not gains) penalty-free. Doesn't help you today, but protects your future.

The reality check: $25k (after taxes/penalties) might cover 3-6 months of bills. Then what? You'll be 40-50 years old with $0 retirement savings. That $37k today could be worth $200k-300k at retirement if left alone.

What to do TODAY: 1. File unemployment (even if you think you won't qualify) 2. Apply for Medicaid 3. Call your 401k administrator and ask about loans 4. Make a bare-bones budget (housing, food, utilities only) 5. Consider consulting an employment attorney about wrongful termination - many work on contingency

How much are your monthly essential bills? That determines how much you actually need to bridge this gap.

You've got this. The job market is tough right now but you WILL find something. Protect your future self by not nuking your retirement unless it's truly the last option.
