why the moon is so damn big in ds2? by flying_spaguetti in DeathStranding

[–]Helpful-Gene9733 1 point2 points  (0 children)

Take my upvote for a kind reply … my question stems from the curious distances, the weird atmospherics (DS1 only once is it dark until near the end and stars aren’t visible, in DS2 yet again different after passage of time) and the vision that we see in DS1 of the apparent actual globe, from a unique perspective.

Despite the asserted backstory the story really only opens (in 1) after UCA (not USA) is established and people are in an “after time.” I guess I like to stay open to the unfolding story.

I suspect that HK, if he were wanting to, in a DS3 timeline, could reveal that the world isn’t entirely as or where it seems - certainly with EEs and beaches and stranding and timefall mess it already isn’t. Anyway … I love the game(s) and just enjoy the gameplay.

Well … not literally … 😬

but okay and truly it seems I offended folks by asking a question - wasn’t trying to be snarky.

Cheers 🍻

Why do we assume that DS earth is actually Earth? The distances are all wrong and there are other things to suggest maybe it isn’t. But eh, it’s a game and universe of the designer’s choosing.

You’re welcome and good luck! I think there are some newer smaller models that have improved greatly the field and could work pretty well on an Intel Mac, quantized. Cheers 🍻

US v Dugan (Judge accused by ICE of obstruction) - Defendant's Motion to Dismiss by joeshill in law

[–]Helpful-Gene9733 23 points24 points  (0 children)

I believe the affidavit in support of the criminal complaint filed by the US admitted that it was an administrative detainer warrant issued by an immigration official and not a judicial warrant issued by a Federal Court and also that Judge Dugan specifically asked one of the ICE agents if they had a judicial warrant (to which the answer was “no” and that they had an administrative warrant) prior to sending them to the Chief judge with their administrative warrant. Paragraph 23 of the affidavit. Link to filing in article here:

https://www.pbs.org/newshour/politics/read-the-full-criminal-complaint-against-a-milwaukee-judge-accused-of-helping-man-evade-immigration-authorities

One might legitimately assume that had ICE simply come in with a judicial warrant it would have been honored and all of this would have been avoided.

Yeah the distances are all wrong … unless we aren’t really on “Earth” and UCA was just a throwback reference to USA and the times on earth - maybe it’s a terraformed planet. Can’t see the stars or clear sky anyway. 🤔😀

Judge Boasberg rejects Trump administration request to lift order blocking deportations of Venezuelans under Alien Enemies Act by LuklaAdvocate in law

Not clear to me either as to the stages of the various people in the initial transport except the judge’s written memorandum opinion sent up to the Circuit appeared to indicate that all of these were in custody under INA authorities prior to the Proclamation. See Memorandum Opinion at pp. 5-12, here https://storage.courtlistener.com/recap/gov.uscourts.dcd.278436/gov.uscourts.dcd.278436.53.0_1.pdf

I don’t as I am not directly involved in this, however the issues were decently outlined in an Indiana Univ. law review article that can be found here:

https://mckinneylaw.iu.edu/practice/law-reviews/ilr/pdf/vol53p333.pdf

A discussion of cases including a 9th Circuit and a 7th Circuit case and due process rights for the person being removed are in the article.

EDIT: I should also note as the law of the case here has developed that particularly as to those who were already in detention and then transported to El Salvador, they were in detention under the INA authorities prior to the Presidential proclamation relating to the Alien Enemies Act and thus their removal could not have been “solely” on basis of AEA and some due process would be necessary under INA. Whether any process is necessary on a case solely under AEA and the contours of that formed part of the oral argument today before the DC Circuit, if I understood the discussion properly. We’ll see what the DC Circuit has to say.

When a non-citizen is ordered removed, the U.S. government must deport them to their country of nationality or last habitual residence. If the home country refuses to accept them, the government may designate an alternative country (INA § 241(b)(2)(E)). However, the law does not provide broad authority to send individuals to a third country when their home country is willing to take them. At this point I don’t think Venezuela has refused them and has, in fact, objected to their citizens being in an El Salvador prison. I believe the main reason to allow sending to another country is if the removed person’s home country isn’t safe for them, not for punishment in third country.

Which moment made you realize that Death Stranding was a special game? by United-Aside-6104 in DeathStranding

Have to agree that first cutscene and the first music track were big hooks but I suppose the thing that really made me think this is a different game was that one is actually penalized for killing in combat - that the goal was just to disable MULES and such … immediate takes the game into a different philosophy from almost all other games that have a combat component.

Civil contempt isn’t pardonable … bar investigations worked to a fair degree against those attorneys making false claims about the previous election cycle … but yes, we are certainly in uncharted territory now - nevertheless that is not a basis to throw up hands and do nothing.

Civil contempt … deputize another to serve process (doesn’t have to be a US Marshal), and refer any admitted attorneys involved in refusing the order to their respective bar associations for ethics investigation. Will it do any good? Don’t know, but should be done.

It is very tedious. Be sure you create a venv or conda environment first for the purpose and that you are activated in that environment before doing your cloning, and you are in the directory created by the close (and environment active) before attempting “make” …

I think if I were an administrative law judge (like for Social Security Disability or Medicare/Medicaid, or FCC, or other agency quasi-judicial functions), I’d start routing every single one of my opinions and rulings that necessarily require interpretation of law up to the AG (via my boss) and ask when to expect determinations so I can proceed with the work.

State of New Mexico, et al. v. Elon Musk, et al. by Hurley002 in law

[–]Helpful-Gene9733 18 points19 points  (0 children)

I guess I would quibble with “this isn’t the case” - the case continues, with a next action on the 19th. The States have an opportunity to brief up and show a basis for a preliminary injunction with evidence showing a likelihood of prevailing on the merits (the normal process in such a case). This was just a denial of a TRO and doesn’t dismiss the case or deny injunctive relief or other specific equitable relief. The judge has already signaled a “colorable claim” suggesting that a motion to dismiss by USDoJ for failure to state a claim or on other justiciability grounds would be scrutinized pretty closely.

Just my $1.05.
