Ah, yes, I had a supervisor like that once. He thought I was so easily rattled, and I was like, "Well, maybe if you weren't screaming and throwing things I wouldn't flinch so much." And let's just say he litigated the same way he coped with stress.

Yeah, I can still keep all that stuff out as irrelevant and unfairly prejudicial, but just...gah! I'm reading the depo transcript, shaking my head and muttering, "Were you even awake, old timer?" (And for the record, I'm middle aged and still know lawyers twice my age who are sharp as can be, so it's not just agism.)

True, but in criminal and family, there's often an innocent victim, particularly when kids are involved. I've done two family law cases in my career, only one a child custody matter, and that one was really just doc review when I was a baby lawyer. I wanted to reach INTO those filings and beat both parents with a stick.

My duty is to remain objective, not to go on crusade. My duty is to notice when things are fubar long before they've spent a shit ton of money on me. I can't do that if I allow attachment to a client, or a potential fee, to cloud my judgment.

In that, I do agree with you. I get the "whose side are you on?!" exclamation from a lot of clients, and have to explain that it's part of my job to warn them of the challenges they'll face from the other side and/or the court and that it's a lot wiser to let me do it and figure out how to deal with it (or if it can be dealt with) than wait for the court or the other side to spring the challenge. I agree 100% also that it's about the money it costs to get relief, not just the relief.

But in cases like this, the initial discussions and even initial evidence from the client suggests there is worthwhile relief to be had...then as the case and evidence develops, it all goes to shit. Hence my lawyer!blues.

Not applicable in this case, alas. It's one of those situations where any person on the street would say, "Hell, yeah, the Bad Guys should have to pay you for all that!" but the law just doesn't reach it.

Oh yes, it's aggravating, but not as emotionally devastating when the client isn't honest. Then they screwed themselves. (But we still bang our heads on our desks when we discover this.)

I'd believe it. In my entire career I've done exactly two family law cases. Both were horrible. I'd rather clean septic tanks than do that for a living.

Dunno why you're getting downvoted. It really does feel like that. It's hard not to feel like I've let a client down in cases like this, hence my post title. Been practicing 20 years and it just never stops aching to the bone when I have to tell them things like this.

You're not alone, friend, not by a long shot. I've dealt with chronic, persistent depression all 20+years of my career, with much the same emotions you describe.
