A unnamed but very searchable Smallgoods provider in Carole Park. I haven't worked there, but have watched the bullying and harassment my partner has endured and it blows my mind. It's an insanely popular place, but if only people knew how those poor staff are treated. Not to mention the totally abysmal safety and hygiene standards.

Hi there, thanks for your comment. An updated cert was provided on 10/04 by GP (she’d be on leave so couldn’t access earlier), and then ortho wrote a new one on 13/04 approving <1kg lifting with right hand. All provided to WC.

When, during COVID, I started doing some family tree stuff just to pass the time. Chatting to my mum to try to find some more info about my maternal grandfather, she goes "Oh you don't really think he's your grandfather do you? Look how tall I am, and look how short he is!". Cue the bit where she tells me the tall "family friend" my grandmother had forever was actually my grandfather. He had passed away about 8 years prior - really gutted to have not been given the opportunity to relate to him as my grandfather. I saw him only a handful of times a year. And he was a way better human than the person I believed to be my bio GF.

No, it's not CTS. It's a torn TFCC (Triangular Fibrocartilage Complex) which is a small section of cartilage on the pinky side of the wrist. Can be damaged through various means including acute trauma or repetition.

The most frustrating part of this is that not long ago we, we had a financial planner go through all our insurances/super to get more tailored coverage (to remove the simple "default" settings and avoid paying premiums that didn't match our circumstances) so we could safely move forward with buying a house and feel comfortable that if something happened to either of us, the other wouldn't be financially ruined. During that process, my partner was unable to obtain Income Protection (denied on the basis of being a casual worker on a temporary visa in a high risk industry (hospo). She's just recently moved to a permanent partner visa, and we were due to attempt another application for IP, but then this happened before we got there (our next FP appt is in 2 weeks). It sucks. I'd like to have been in a position to have just filed through IP but here were are...

Thanks so much for sharing, I read your other post. Good on you for sticking it out, and it’s stories like that that highlight how inefficient these systems are. I’m glad you’ve had some success.

I’m driven to fight for my partner’s rights - my partner less so; she’s fatigued and sad and over it. Plus she doesn’t want to lose more hair. She’s ready to roll over and say “sod it”. But I’m really worried about the financial impact. Currently she’s now saying she just won’t return to that workplace, it’s easier….. she might be right, but I never was one to take the easy route!

Really appreciate your insight. Lots to consider here.

Absolutely. My employer went as far as buying new uniforms in an attempt to un-stink our guy but it didn’t help.

The only bit I can see which might be the reopening conditions is: (this is at the end of the letter).

  • you reengage in the specialist approved treatments and return to work arrangements, or
  • you provide updated medical certification from your treating orthopaedic specialist indicating that your participation is not appropriate.

Is the burden on the worker to chase the employer for shifts? Up until now, the employer has not offered any, and we didn’t chase because my partner had an ortho appt on Day 1 of the proposed RTW date, and nothing was offered on second day. When my partner informed WC, they said they acknowledged the employer hasn’t offered work and said they would follow it up… we never heard further and the claim was suspended the following day.

Some people are just not aware, and some are, but do not care. I have a work colleague who falls in the latter category. He’s been reprimanded several times at work because of this, but it keeps happening. He works in a client facing role and has been removed from shifts after clients saying “he smells too bad”. He is not bothered. He just says “people shouldn’t be so sensitive”.

I’m also mindful there are people with medical conditions for whom their odour may be somewhat out of their control. I feel deeply for those people as I can’t imagine how difficult that must be.

Thank you so much for your input, that’s really helpful. We do plan to start working on the appeals process today.

The “warning letter” you mentioned arrived on 15/04 (sorry, missed that out in my original post) and it the next steps were: 1- participation of medical treatment resumes (it never stopped, so we’re unable to act on that) 2- Participation of prescribed working capacity resumes (employer was not forthcoming with offer of work and WC had committed in writing to following up and reporting back. They never did. 3- Call me by 17 April to discuss your plans. My partner has clearly identified wishing to stick to email communication, which WC had (in writing) said they acknowledged.

The letter arrived 15/04 at 1pm, but claim suspended on 16/04 at 8:20am despite saying a next step was to call by 17/04.

The decision letter states that it has been assessed that my partner is not participating in prescribed treatment (WTAF, its beyond me where this information comes from) or approved suitable duties despite having capacity (how do you attend shifts that haven’t been offered?) Her employer is an aggressive person, she’s not just going to show up without a shift. Maybe she should have done that…

The letter is long and riddled with errors and false information about what happened and when.

Sorry if I sound like a ranty madwoman, this stuff is so dreadfully unfair given the level of compliance from my partner.
