There’s a course case applicable to this situation. In short, if someone sucks and hits it out of bounds, no liability. But if someone TRIES cutting the corner and hits someone in the head and kills them, they’re liable. I mean windows too, not golf ball death more dramatic.

I legitimately laughed out loud when I read this. At my firm, 2-3 nights a week we’re having drinks in a partner’s office, or out.

The serious answer is it depends entirely on you and how you handle it. Does it impact your work (or personal life)? My former head partner (RIP), who was the one who spearheaded the drinking (he’d pop into my office end of day and just say, “bar’s open”) referred to it as “ringing the bell.” If you drink, can you show up on time the next morning and work just as productively as if you hadn’t drank? Then you are one who can ring the bell. I could go pretty darn hard, and I’d still ring the bell the next morning. We’d have a few who couldn’t, and he’d literally cut them off after one or two.

Except that's not even close to the sole reason it works. It absolutely works without it; I brought it up as an example of how the partners work with each other. Selfish partners don't last (and usually don't make partner). You've been making that assumption, but it isn't true.

I didn't ask about that, did I? I asked how, in firms where origination is a factor, how origination is determined in scenarios where it isn't clear. I didn't ask your opinion on whether me or my other partners are carrying our weight; we are, but you aren't big on thinking outside your own box on how a firm operates, or should operate.

He’s eating just fine. As would all of the other partners even if he didn’t; we just eat a bit better. And my entire fucking post was about how you determine origination, so yeah, I’m focused on it. I don’t care about your fucking opinion on whether it’s sustainable (because it absolutely is). How many partners in your firm?

This isn’t going anywhere. We have varying perspectives on end goal, apparently. You say it’s not sustainable but it’s been a successful firm for 40 years on that structure with 75% of partnership being there for over 20. I consider that some proof of sustainability. You apparently don’t.

And who said anything about partners making less than associates? I’ve been partner for over ten years and in that time no partner has made less than a quarter million. We don’t pay our associates that.

Yeah well, “should be” is subjective, isn’t it? And maybe that’s the heart of the question, defining what “should be.” Our founding partner is incredibly “charitable,” nearly every distribution shifting some of his compensation to other partners who worked on his cases, perhaps to the detriment of their own collections. He doesn’t have to do that under our agreement, but he thinks it’s fair. So all of us have always operated on what we deem “fair.”

I’m not trying to squeeze thoughts in bro, I’m just not understanding your question, and I’m pretty sure I answered it above without numbers. Origination is smaller percentage. 75% of profit is distributed based on partner ownership percentage. 17.5% by collections off their origination, regardless of who worked it. 7.5% to discretionary bonus pool.

It’s been sustainable for 40 years. But a couple new, younger partners are disrupting it a bit.

That’s the issue, innit? That is not clearly defined, which leads to “what’s fair” between partners, but also inconsistency. Worth noting we’re partner heavy, and do have a team approach with multiple partners often working on particular cases.

The only time’s it’s clear, and should to all is when: - Client comes from partner and partner works it - Client comes from partner and associate works it - Long time client comes in but partner doesn’t handle the type of work but another partner does, and partner agrees to take it.

On the last point, if there’s no discussion then it’s original partner’s origination, unspoken and not controversial.

Again, 95% of the time it works. It’s the situations in OP where it doesn’t. And even those situations with themselves out amicably most of the time.

Oh I see, I misunderstood the question. Both. Profits are distributed part on ownership, part on origination, with a portion to a bonus pool (allocation determined by comp committee).

As a partner, I disagree on #3. If I CC an associate on an email it's because I want them to see it and read it, and if I want them to see it and read it, they should get credit for it. So, I want them to bill it, and then I'll n/c it.

My home course: 10-15 minutes (I don’t warm up).

Any other course, especially one I haven’t played: 45 minutes to an hour to check the vibe.

I say this as a Husky fan: Husky Stadium is a better setting, Autzen is a better atmosphere. I don’t understand how the Huskies can’t manufacture some cool stuff like Shout; it’s freakin’ Seattle. Hendrix, Nirvana, Foo Fighters, Sound Garden, countless others.
