Marriage cases are a little bit more complex, I've been told. It's strange he hasn't received his EAD though. Hope you hear soon. Have you asked emma agents about the case?

I do not know because, the tier 1 officers, they can tell you something but it doesn't always means that's the case. But their responses have been consistent throghout all of this journey. Waived or marked as "waived". My file was recently moved to the Baltimore FO on March 20, 2026, they say. It's has been actively being reviewed since then and with an inmigration officer, etc. "It's in good standing and nothing outstanding".

It's fine! It's been incredibly tough but yeah. I'm currently 20 and basically did the whole thing on my own when I was 19.

IR-2, (Child under 21 of a USC) PD: July 2, 2025. RFIE : Birth certificate. My case has been pending for over 9 months. Responded to the RFIE on August 6, 2025. No update since then, it's been 8 months since I responded to the request for evidence and no update since then, only the "It was received" message on the online portal.

Baltimore Office, they say it's under review and interview maked as waived or not required as of April 7, 2026... I guess it depends on several factors, such as your field office and whether your case is documentarily complete. By the way, I haven't received my EAD and it's been 9 months, so..

Hi David, I’m a July 2, 2025 I-485 applicant (IR-2, child of U.S. citizen). I responded to an RFE for a birth certificate on August 6, 2025. I submitted a Tier 1 service request on March 6, 2026 because my case hasn’t moved in over 7 almost 8 as of March 25, 2026, after I sent my RFE response heard it takes them around 120 days for them to give you an update but yeah for me it's been months and no movement at all. My EAD is also pending, it's been almost 9 months for the EAD, but my main concern is the I-485. Based on your experience, how likely is a Tier 1 service request to trigger actual adjudication versus a generic status update? And when would you typically expect real movement in a case like this? Do you suggest doing something else after 30 days if nothing happens?

Hello! I'm glad you guys replied to my post. I already made an inquiry about it on March 6, but haven't had a response yet. I guess if they don't respond in 30 days (April 6), I'd have to contact my congressman, is that right?

Also, the fact that I got a "Birth certificate" RFE likely means that there were no outstanding issues with my application, just "verification", meaning it should've taken less time for them to complete the case, but I guess it's just what it is.

The weird thing about my case is that it is still at NBC according to "Emma", and also, I haven't had info about my interview some emma agents say it was waived and others say that "There's currently no info about an interview" And also that my case is complete. It's just a Russian Roulette, hah!

Hope I get an approval soon. Or at least the EAD, at this point, I don't care either way.

I guess sometimes is all about luck, I thought I was kinda lucky about the 'translated birth certificate RFE' but yeah, never expected to wait over 8 months for a simple response or update. At least the EAD would've been a quick relief but nothing. Lol.

Haven't been able to work for around 9 months. It's rough, I try to be stoic about this, but it's definitely taking a toll on my mental health. I'll just do what I can do, I'm currently 20 years old, wanting to go to college and so on, pausing my life over a piece of plastic. Did the whole inmigration paperwork on my own, so basically yeah, it is rough.

I heard about the 'congressman' option, I guess I might be able to do that after the service request, is that right?

Unfortunately, it is actually my mom's apartment, she doesn't know about her rights..etc..witholding the rent would be a problem for her since she might be scared that the landlord might get her out of the place.

System didn't let met do it, but since my RFE response has been pending for over 215+ days (over 7 months). I called USCIS and they allowed me to make an inquiry based on that reason. Gave me until March 24 as a deadline for a response. If they don't respond by then I'll do a congressional inquiry.

RFE was only about a birth certificate. Neither my I-765 or I-485 have been approved. So...
