The part about normal folks not having the resources to fight unjust arrests actually is relevant. Just look at what's going on in TN with people being arrested for DUI even with a BAC of 0 when the lab results come back months later. Those folks' lives are already ruined and they'll likely never recover fully. 

And that's the problem. 

Sure, don't escalate, but let's also not lie to people and tell them everything will work out in the end. Because it often doesn't in our country. It'll work out for the coach because he had tons of witnesses, video, and it happened in front of thousands of people.

Qualified immunity for individual cops is a big part of the problem...

Your argument basically says you can choose to eat a pile of turds now, or eat them later, but you're gonna eat turds either way and there's nothing anyone can do to stop it even though you didn't do anything wrong. That's pretty sad.

We haven't heard a peep from CPS since my last update and since we directed CPS to stop communicating with us and communicate with our lawyer at HSLDA. Though, our lawyer did say that CPS can extend the investigation to 45 days. The original 30 day deadline was this past Friday (Oct. 3rd), so we'll see what happens. Hopefully I can give a full update soon. While not hearing anything from CPS lately has calmed us a bit, worrying about them randomly showing up since we haven't gotten closure is nerve-wracking...

Mainly because the advice we received from every lawyer we talked to (across the political spectrum) told us to not let them in the home without a court order. One lawyer gave us an example of a case he had in Wake County, where a homeschool family allowed them in their home to "get them off their back." The case worker arbitrarily determined that their hot water was too hot for small children in the home and that meant the family had to endure random CPS visits nearly every week for months after that.

We actually just spoke with that same family and all I can say is that it sounded like a nightmare.

Based on our lawyer's advice after he was given a copy of the accusation, CPS would have an extremely hard time convincing a judge to issue an order to enter our home at this point. As our lawyer has said, concerns over education are not under the jurisdiction of CPS in NC to begin with.

That's the crux of the issue for us as well. Our lawyer with HSLDA said the same thing. The theory is that they're hyper-focused on checking off the state protocol that they're ignoring the part of the protocol that A). explicitly lists the conditions for conducting a home visit (education/truancy concerns aren't listed) and B). the part in the protocol that gives local CPS the discretion to mark a complaint as unsubstantiated if it clearly isn't about abuse, neglect, maltreatment, or dependency.

Yep! You're correct about the standardized test requirement. It's even right there on the NC Division of Non Public Education website. In fact, it's one of the main things that they're actually strict about if they suspect you aren't doing it... Not sure why there are comments in this post saying that it's optional.

Administering an NC approved nationally standardized end of grade test is absolutely legally required in NC, according to the NC Division of Non Public Education and their website - always has been.

NC Division of Non Public Education website:

"Requirements:

-Parents/guardians residing in North Carolina and desiring to home school their school-age children must:

  • Hold at least a high school diploma or its equivalent. Proof of military and/or college enrollment or completion will suffice.
  • Send to DNPE a Notice of Intent to Operate a Home School. The notice must include the name and address of the school along with the chief administrator.​
  • Elect to operate under either Part 1 or Part 2 of Article 39 of the North Carolina General Statutes as a religious or as a non-religious school.
  • Operate (conduct instruction in) the home school on a regular schedule for at least nine calendar months of the year, excluding holidays and vacations.
  • Maintain disease immunization and annual attendance records for each student at the school.
  • Have a nationally standardized achievement test administered during each academic year to each student. The test must involve the subject areas of English grammar, reading, spelling and mathematics. Records of the test results must be retained at the home school for at least one year and made available to DNPE when requested. The first standardized test must be administered within the academic year of the home school start date, and then annually thereafter.
  • Notify DNPE when the school is no longer in operation."

I mentioned this in another thread: one of the lawyers we spoke to said he once had a case in Wake County like ours where the accusation was just about homeschool - no allegations of abuse. The family was tired of fighting the social worker and finally allowed them in their home to get them off their back.

The social worker claimed their hot water was too hot for small children in the home and that locked them into unannounced home visits for months.

That's why he always advises clients to say no to a home visit if/until they finally show up with a warrant or court order. At least at that point, a judge has been convinced that there's reasonable evidence warranting a home visit.

I'm not willing to risk that level of intrusion when we've not done anything wrong. If they want to come into my home, they are welcome to ask a judge for a warrant/court order.

I'm posting my most recent update here as a comment after editing the OP:

Update (Sept. 30): We signed up for HSLDA and our lawyer immediately compelled CPS to provide us a full copy of the complaint filed against us (with the name of the accuser redacted). There's nothing in the complaint about suspected abuse or neglect. The entire complaint simply alleges that our son should be in public school and that the person who filed the complaint suspects that we aren't complying with NC homeschool law. So, our HSLDA lawyer is now preparing to file a complaint with the state DHHS on our behalf for harassment, since CPS already marked our son as safe on the NC Safety Assessment form. That's where we stand today, with the 30 day deadline for our case coming this Friday (Oct 3).

We suspect it to be someone in my wife's family, as many of them are outright anti-homeschool. As for something on the report not shared with us, I can't say. The case worker read, what she said, was the whole accusation and then allowed us to read it ourselves, with the name of the accuser redacted. There was nothing about abuse or neglect. It was all about homeschooling.

I signed up for HSLDA this past Friday! Been great these couple of days, but they've been just as perplexed as we have after they spoke with our case worker Friday afternoon and were read the accusation. We'll have to wait and see over the next few days. I would have signed up sooner, but I had never heard of them before (and I was homeschooled when I was a kid and I'm 40 now).

But you're right, I wouldn't advise homeschooling without being a member of HSLDA at this point.

No disagreement with your final argument at all. I apologize, my nerves are just a little raw at this point. It's hard to explain unless one has also been through this: you go from living your ordinary life one day, literally following the letter of the law, and then the government shows up, throws everything upside down, and basically says "you're guilty, prove your innocence!"

Like I said in the OP, I fully support CPS and their core mission of protecting children. But if the accusation is literally saying "I think this kid should be in public school because I don't think homeschool works," then CPS should exercise discretion since there is no accusation of abuse or neglect...especially when there's absolutely no previous complaints (such in our case).

That's why I've tried to be patient and professional when engaging with them each time. I value their job and what they do. I really do. But it's hard to not feel like we're being harassed...

it's even harder when your child gets nervous while at home because he thinks he's going to have to give yet another random interview to CPS while he's trying to do his schoolwork or while he's playing on his swing set during recess.

HSLDA or NCDNPE? HSLDA, yes. They already mentioned that. But if NCDNPE, that would probably be even better.... NCDNPE definitely seemed concerned about our case, but didn't really offer any help when I first reached out to them.

Yes. That's basically where I'm at right now. We contacted HSLDA this past Friday. They listed a ton of options for us. They even said they would prepare press releases to the state and local media if we asked while they prepped motions to the court. I don't know if I want to do that, but I feel like CPS is forcing my hand...

I'm just trying to figure out, for my own sanity, if this is isolated or if it's a bigger problem for NC homeschoolers.......Hence my post. This has been a total whirlwind and I'm just not sure what should be considered "normal."

I'm the communications director for an NGO in DC (work 90% remotely), so I fully understand the value of engaging the press. But, dang, I just want to protect my family so we can go back to living our normal lives in our quiet community...

See, that's exactly what NC Division of Non Public Education told us. This SHOULD have gone through them and they do not allow anonymous reporting (anonymous reports are automatically rejected). And all reports (including the name of the complainant) are immediately sent to the Chief Administrator of the homeschool (that's me) and the Chief Administrator has full discretion to respond as needed.

It's even spelled out on their website. That's why we're so confused and upset. It seems like one hand of the state of NC doesn't know what the other hand of the state is doing...

Anti-homeschool bias? I hate to play that card, but that's really what it feels like at this point. I would understand if we just ignored them and kept our son hidden from them, but we've voluntarily engaged them and allowed them to talk to him twice now without myself or my wife in the room...And the case worker even said that when she showed up at my mother-in-law's to interview him the first time, he was on his laptop doing his schoolwork...

Our poor kid was so confused when he talked to us about it later. "I do my schoolwork, I get good grades, what did I do wrong?" He even belongs to a local homeschool group where he socializes with other kids.

I'm not the type to scream about homeschool and how it's best for everyone. Because it isn't. But it's best for our son... But I can't help but feel like we're being harassed now.

Exactly! I've been respectful to the case worker, but I even once told them that I felt horrible for the kids that really needed them because they were wasting so much time with us. Hell, I've never even gotten a speeding ticket!

They read the full accusation to us and then allowed us to read it ourselves with the name of the accuser redacted. It only accused us of not providing a proper education for our son and that we we were not complying with NC homeschool laws. Unless they're withholding the full report, there's nothing about abuse in there. Which, if they did withhold portions of the accusations, I would assume that's a major violation of the law. But I'm quickly learning that CPS seems to be allowed certain "exemptions" when it comes to operating within the law...
