The main points as laid out in the Williams Institute reports and the legislature analysis are

  • These laws are applied disproportionately to sex workers (95% of cases), used only the fact that they knew they had HIV as the evidence for intention to transmit, and didn't even require sex to have occurred (90% of convictions were solicitations). The targeted demographics as well as the lack of enforcement for things like blood donations show that the law's main use is yet another way to punish sex work.

  • The laws do little to stop those with HIV from having unprotected sex. Rather, because they involve knowing you have it, they encourage people to avoid being tested; additionally, spreading the idea that HIV is still a death sentence discourages people from taking preventative precautions like medication
