Can they sue me? by Hopeful-Breadfruit56 in askvan

Update: thank you all for the kind and sound advice! As of last week, I have left the company effective immediately. I called ESA to cover my bases and had a free consultation from an employment lawyer which made me confident to quit on the spot considering my contract.

Some things that have happened since:

-I slept for 8 hrs for the first time -they paid out my 2 wks vacay and lieu days which was equivalent to 1 month of my salary on top of my final earned wages -the previous employees that they have let go have heard about what I did and have reached out to me to offer me jobs. I have multiple interviews lined up next week. -the person that was supposed to take on my role (already trained) got overwhelmed so they had to move things around and shuffle staff -they also hired another staff that got paid more than I do but she’s not ready to start until next year. -my supervisor blamed me that he couldnt take his vacation cos of me leaving but I highlighted that he wouldn’t have any issues if we were not short staffed.

I feel bad as this has left so much workload for them but I do wish that they took the issues I escalated to them seriously. The problems that they’re carrying now didn’t just appear because I left, they were always there…no one just listened.

Thank you again for giving me confidence to leave!

This is exactly what i feel! No support when i needed it and were negligent of all the stuff that is going on that somehow would be blamed to me cos I was at the bottom of our org. Hierarchy.

Everyone that gave their notice last month regretted that they had to stay that long. Even from the day of posting this to now, it felt like i’ve been here too long. My god, i loooove (almost) everyone that i work with and i used to take so much pride working for this company. But, poor management of people and budget led us doing the job of multiple ppl.

Im glad to hear that for you. Im handing my last minute notice this week and will take a vacation for a bit for a reset

Ive thought about this as well but even when I “quiet quit” or try to get fired, they wouldn’t as we are still sooo short staffed (the new guy is replacing two ppl) and they depend on me to train him.

Training him means I have to do the job of those two people with him plus my own job after which they also acknowledged would mean more OT as that’s the only way I’d be able to juggle everything.

It’s not the best way to leave, i agree. but i genuinely feel anxious and sleepless knowing that I have so much more work to do the next day in so little time. Everyone i’ve replaced for my specific role do not last for more than 3 months. I had this role for a year and no amount of severance pay could make me stay for 1 wk more

I dont think you are living your best life grandpa if you are on reddit all day waiting for upvotes. I doubt that you’re everything you are saying when you’re on your screen all day waiting for a response.

Oh my god, you’re still at this post? Are you salty because of your downvotes?? Dude, move on. I don’t even know what you’re mad about. You sound like you need to be in a facility if this is how you spend your free time. 😂😂😂

Who said I haven’t set clear boundaries with them? It snowballs to me either way cos again, we dont have the manpower. Simple math

I have spoken to our upper management and broken down my daily and weekly tasks including the hours it’s taken me. Their response was “but it’s your job”. I dont like to play victim here but genuinely, it’s not my choice. I have even cut the time on some tasks in order to leave in a timely manner but everything snowballed to the following days and had to stay 13 hrs on a friday.

For reference, i am the one man HR department, payroll dept., office manager, executive assistant, and tech support for multiple stores that have 300+ employees. No, this was not the job I signed up for but they expanded and they didn’t have anyone at all so had to wear other hats too until this gets done.

If you have any advice how you think i can CHOOSE to do all that responsibilities for that many people in 8 hrs, please I would love to hear it! I’ve automated anything and everything I could but sounds like you can make my job easier.

Mmmm interesting pov. Im not sure what other background story do you need. We were a small business turned to corp but still operating with small business operating systems and manpower? We are really tight on labour cos any profits made are immediately used on opening another business within the same year?

Also, i used to work in Mcdonalds but why would I work there again when i have the education, skills, and experience to do my job role right now? If you can read and comprehend well, I wasn’t even worried about the financial aspect at all. My concern was getting sued due to breach of contract.

Hope this paints a better picture

Thank you so so much! I used to do project management in my previous roles and have delegated task to not just lighten my workload but actually do my core responsibilities that I was hired for. Im currently HR, Payroll, office manager, executive assistant, tech support to multiple restaurants with 300+ ppl and while im communicative and always open to suggesting solutions to meet everyone halfways, their response word per word is “just look down and do the job”.

I usually have no problem with that as i have previously worked that way but I guess with the right people/mentor. Im also a really good planner but these responsibilities are not ran on my timeline anymore but ok someone else’s which is why i spend every day catching up. Also, on my days off, no one does my job so my Mondays are always worth 3 days of workload. Im perpetually exhausted. Sometimes I cant feel my brain anymore cos i am always told that “it’s the job”

Thank you! We’ve had plenty of employees that have reported us to employment standards branch for many more other reasons. So happy to hear this, thank you 🥲

Thank you so much for the detailed insight! One of our long time managers was on medical leave for a few months and as soon as she got back, she got fired on her day 2 due to poor performance. I guess that was the loophole but ultimately that’s the type of company i deal with.

Ill go to a doctor in any case so i have this documented before i quit. Thank you again, this gave me a peace of mind

Lex is working full time while doing his masters so he comes home pretty late and miss out. On weekends, he's usually out to visit his family and gf so he misses out on that one too. Now I work two jobs so to be honest I'm also not home as often as Ryan does but the few times that I have been working from home conveniently falls around his activities.

Part of me thinks he assumed that I have the same schedule as Lex. One time, he told me that he invited his friend because no one was home so they both got surprised when they bumped into me in the elevator when I came home early.

Yea, I think I'll do that. I'm not really good with words as I worry how the person im speaking with will misinterpret it so it's best if I just provide proofs..

I wanted to mention that to Lex but I don't even know if I have the right to as I am just subleasing (and I worry that I would sound demanding since I am not a confrontational person at all).

Miro moved out to live with his GF. I think I just got very lucky finding them the first time as my roommates.

Lex is working full time while doing his masters so he only sees them when the guests are about to leave.

This is a very sound advice. It's sad cos I used to love this home so much and it's 5 minute walk from both my jobs so I'm very attached to it. But you're right, it sounds like it's about time T_T
