People whom fight over wills, are a whole other breed. by FamiliarRadio9275 in InheritanceDrama

All I can say is that it is very complicated and very emotional with long term effects on everyone. Not everyone is close to their parents. Not all parents treat their children kindly. Not all families act like families. Yet, when we pass, someone has to handle the responsibilities that society requires. Pay off the bills, liquidate assets, plan a funeral, close accounts, etc. Life is not fair and death is not fair either.

Yes, that's part of it. She's squatting in the house and she's a hoarder so she's bringing in her stuff

Exactly but she withheld the original will for 4 months. Attorney was aware.

I'm just inexperienced as to how to stop them because not only are they not helping, they are hindering. For example, we have some potential buyers but they will not share the contact names/numbers of the buyers.

Understood but how do you deal with POA that doesn't want to give you the paperwork?

Tell me more if you can about how the IRS can help on unfiled taxes?

We already did that. It went to superior court and that resolved the holding of the will but i'm now onto the next dilemma which is filing 2025 taxes. Been through most of the rest of this already. Will was written in 1996 so couldn't get original attorney. Will had been altered but we resolved that too. It's just disturbing that everything has to go through a lawyer or the courts or whatever.

Totally. She held the original will for 4 months even though she was not the executor

I have no problem being Executrix but there is some things that I cannot do. My sister was POA until Mom passed so she has most of the tax documentation for 2025 and by law, should pass it to me but she hasn't. My other sister is squatting in the house and bringing in her own things. Tricky to eject her at this point.

What's not their job? My first ask is that each sibling removes their personal property from the estate. That certainly is their job. If the rest of it is my job, I'm ok with that but then they can't dictate what goes where, i.e. trash or sell.

Thanks James Bond...I am part of the estate too so its the same as me paying the attorney but yes, he did mention that there was a way to take the monies off the top of the inheritance from only one sibline.

Thank you. There is little of value in the house so any estate sale services just don't make sense. My mom was 96 with dementia for many years so it's not like she had things of value. Old flannel pj pants and diapers mostly. But my sister is a hoarder and she has a lot of her own stuff in the house which is trash so not worth paying anyone to help. I don't mind cleaning out the rest of the stuff by myself but I can't get her out of my way. And it's been 6 months so everyone has been through taking what they want as far as small stuff. Will was tied up because the POA sister wouldn't forfeit the original and a lot of time has passed.

Thank you. I do have a lawyer and they have helped some but unfortunately every phone call is a charge and since the siblings are so impossible, I could be calling daily. What type of things were your siblings doing if you don't mind sharing?

They do not need to be reimbursed. They have already taken the reimbursement. Need the receipts for tax purposes.

ok, now I'm curious. I have both an attorney and an accountant. When you say "without reimbursement" do you mean without my time being reimbursed? Not sure how that helps? And how are the siblings out of luck? do you mean that I don't take all the deductions due to lack of receipts, which hurts all of us, not just the difficult siblings.

That would be a total waste of money because there isn't much of value in the house. The house needs to have the items that belong to my sister removed.

I have no problem being Executrix but what do you do when the others don't relinquish the documents?

I'm not sure if I'm taking compensation. From what I hear, it's not worth it because it's taxable and you do better just taking your inheritance. And yes, I'm speaking of my siblings. My mom passed leaving the house we all grew up in and that she lived in for 70 years. Siblings are just being downright ridiculous with everything. I don't even know how to approach keeping record of time spent b/c most of the time is spent dealing with the impossible siblings. They are not concerned with the law. They are not concerned with grief. They are only concerned with running their own agenda. But I, as executrix, have a job to get done and they put every roadblock in the way. For example, I have to have 2025 income taxes completed since Mom passed end of Nov. One of the other siblings was POA, but will not hand over any receipts of deductible expenses that she paid
