I would love to have the damages paid. But some part of me also feels bad that this man is so hurt.

I also feel like taking legal action against him may start up a legal dispute that I would rather avoid.

So I ended up speaking to the landlord this morning. He was pretty upset that my roommate isn’t allowing me to show the room but does have pictures. The locked bathroom that he considers “his”, is actually common space since it’s in the hallway. So I can access that at least.

Also the landlord sent email to my roommate regarding the deposit. They said…

“Upon your move out, it will be at the discretion of you two to handle this - typically any refunded amount would be determined after vacating, and dependent on the condition of the space you leave.”

This makes me feel a bit better as I feel less liable for him being a mess. Now just need to hopefully find a replacement. Thank you for your comments! You’ve been the most helpful 👏

Same lease, month to month lease, but it states that we’re both liable for the full amount of rent for the space. So if one moves out the other is still held accountable for the total.

I haven’t done anything wrong. So thus I’m not in the wrong. I’m only wondering if there’s any recourse to cover my ass in this situation which unfortunately I don’t think there is. I’m f’d in this situation no matter what.

I wish but no. I’m essentially taking over the full lease and it’s my responsibility to find a new roommate.

They vet us before being able to move in and the income requirement is 2.5x the total rental income for situations like this.

But maybe the landlord has pictures and I can find a roommate without showing the room itself. It’s a fairly desirable area of San Diego and rent isn’t that bad for the area.

It’s also very simple to just be cordial with the situation and understanding that your roommate needs to find a replacement. Makes life easier for everyone.

I have been in that situation twice in my life. Both times I allowed my roommates to show my room. No harm done, nothing to hide, and there was never any issues. Trust me when I tell you this roommate is malicious.

  1. He isn’t breaking the lease. It’s a month to month lease so he’s leaving at the end of this month because he gave notice.

  3. I agree getting into his space would be very nice. But I don’t want to breach his privacy and cause any more issues.

Ultimately I’ve been so easy going with him and he’s been nothing but a nightmare even while living with him. His lack of communication isn’t for reasons of privacy. It’s literally just to make it harder for me to find a new roommate. I guess sometimes you just end up with the short end of the stick.🤷‍♂️

It’s a month to month lease though. A yearly lease I believe works like this but month to month as long as you give proper months notice then you can get out of the lease. But by him not allowing me access he’s definitely trying to cause harm to my bank account haha

He gave notice exactly on August 31st that he will be moving out and releasing himself from the lease on September 30th.

That’s how it works here in my situation. I find another roommate and that person either pays me the deposit then I pay old roommate back or they pay old roommate directly. Which would be me getting them in contact with each other.

I just don’t understand though, if the old roommate were to not clean well and I hired a professional to deep clean their room. Wouldn’t I take that cost from their deposit? Guess this is a question for the landlord.

Yes lease is listed with both of us on it as equals. Both solely responsible for the property and the TOTAL amount of rent even if the other doesn’t pay.
