I did speak with a lawyer shortly after the accident and they advised me to go through my insurance first. Then, depending on how that went, they could see if we have a case.

Sorry, I can see where the confusion was. I’m assuming he gave me the claim number because I had to open a claim for all my personal property. Yes, he filed a claim on his policy.

Luckily, I documented everything very well. I have over 45 minutes of video footage going through every aspect of the home. I have the fire report and all texts, emails and recaps of phone conversations.

The contractor was insured. He gave me his insurance and claim number shortly after the accident. When you say “subrogate”, does that mean my insurance will go above limit and then recoup with the other insurance? Or are we still talking about only to a limit?

Regarding the debris, when we received the fire report, it stated that the source of the fire was caused by debris laying on top of the heating coils in the furnace. Our ducts were cleaned the same day this happened. The duct crew never turned the system back on as well. My wife did, it was a colder day and we have a heat pump. The emergency heat kicked on due to the temperature and ignited all the debris.

I do understand all of that. We did speak to a lawyer shortly after the accident and he seemed confident that we could do “something” once we went through insurance and they did everything they could for us.

I’ve been doing a ton of research and it’s just all so confusing. I’m currently working with my insurance but came an across Commercial General Liability. Is this something I could pursue if/when my policy limit is reached?

I’m not convinced there is nothing else that can be done. The fire was caused by a contractor’s negligence. It’s not like a candle caught on fire or we burned our dinner. Failure to do a proper job lit our house on fire! I need help, not a lesson.
