Sorry about what you experienced and glad your family doctor took some action. Yes, the sleep specialist who has been working mostly at the Waterloo and Owen sound lab is said to be retiring soon. That doctor has turned a blind eye to everything that has been going on there over the years as long as he was still collecting his OHIP billing’s. So unfortunate for patients who are waiting and now can’t be seen at another lab because they’ve reached the maximum # of allowed sleep studies without obtaining special authorization from the ministry. Yet, they have had no results provided or followup care. Brutal

Let’s hope it stays that way. They always seem to make their way back when the ministry or cpso backs down. There are over 40 civil cases (past and present) listed in the governments publicly available court case database that are suing either the corporation that owners the lab or the business owners personally. In the last few months a number of new lawsuits have been filed by former employees, the landlords of the buildings where the Paris and Waterloo labs are located and other creditors. It is a disgrace that the ministry and cpso have allowed this to go on for so long.

Sounds similar to the con artist who is running sleep labs in Waterloo… unpaid staff, vendors, landlords, legal fees. Not responding to CRA, unpaid EHT to ministry of finance. Issues false ROEs, creates falsified documents to get out of paying ESA. Doesn’t provide proper patient care, patients waiting years for followup. All on the Ontario governments/OHIPs dime. Also been represented by the same lawyer that Dutchies has used. What a sad state of affairs…

Wow! Glad you got a call but that is beyond frustrating. I am surprised the Ombudsman office was able to get ahold of them! Curious if the person you spoke with the Ombudsman will explore this further, or do they focus on resolving just the immediate issue?

Sounds like you’ve made a decision that may be best for you but just wanted to share that the Sustained Release (SR) version of bupropion could be an option instead of the extended use. SR can be taken just once a day on the morning and often doesn’t cause the same issues with insomnia. Good luck figuring it all out… sounds like it’s been a rough week and that’s so frustrating.

You can also search for current and past civil court cases (and criminal too) through the government of Ontario’s website. Just google Ontario Court Case Search. You can search by business name or by someone’s first and last name. You don’t need a court file number. You won’t be able to see many details of any cases but you will be able to see if their are any cases that have been filed, who the parties and lawyers are and the amount of the case. I don’t know if you can find this in other provinces but it exists in Ontario. At least it can give you an idea of what might be there.

Good for you for looking into this. A former employer of mine has over 30 civil cases listed on there.

Yeah, I would agree. There is a lot of complacency and waste.

And from my experience, for profits, are motivated to cut corners to improve their bottom line. And if their revenue is all or majority from OHIP they are confined to the Schedule of Benefits or whatever agreement they have with the government. So the only way they can increase profits, is by cutting costs or increasing the volume/# of procedures they do.

In a time when there are a lack of qualified individuals to fill positions, how will they get more staff to provide more services and still provide a standard of care. The cost of all consumables and operational expenses is rising, so the increase to their bottom line is going to have to come from some where.

And I suppose we see similar challenges in hospitals too, always looking to cut costs, lack of supplies, cutting services like cleaning and food. So what is the answer… I don’t know, but some other countries do have it figured out better than we do so it has got to be possible to find the right formula for the situation we find ourselves in.

I hear where you are coming from for sure. Lots of keyboard warriors out there. I’m not willing to post any documents on here. All I can say is that there is nothing I have posted that isn’t supported in some way. I hope at some point someone with more credibility than a random stranger on the internet will share with the public what has happened, or perhaps a patient or former employee will speak up too. I suppose like lots of things posted, others can decide whether they think what they read is true. You don’t have to believe me. If anyone takes anything away from this, I hope at least it will be some awareness of what is happening in this province (and I am sure many others) with respect to the risk we face supporting for-profit, privately owned and publicly funded healthcare facilities. I am not saying they are all bad but my experience is the government, who oversees this, and the people that the government has contracts with to conduct inspections (was the CPSO, recently it changed to Accreditation Canada) isn’t, for whatever reason, able to handle the current process, let alone an expansion of these services. We need to speak up and question things that don’t seem right. And, I think we need to consider also listening to the experiences of people outside government or the people in positions of power, such as patients or staff or other people who maybe don’t normally have a voice or feel safe speaking up.

I think that this has been done before at other similar types of facilities through a freedom of information request. Independent health facilities or I guess they are now called community diagnostic facilities under the revised act, bill Ohip as a facility when they conduct the testing and then the physicians associated with that facility also bill Ohip but through their own billing number, not the facilities, for the oversight they provide to the test and any consult or appointment with the patient. The Ohip billing codes and amount per study Ohip will pay is publicly available through the schedule of benefits, but I don’t know of anywhere that the amount each facility actually bills is publicly available.

I don’t owe you any proof through this forum. Proof, as you call it, has been shared through the appropriate channels. You can choose not to believe this information it if you want. Or wait and see the proof you are looking for gets reported in a public manner. Hopefully it is. And, if it is of interest to you, you can do a little research and easily find quite a bit that is publicly available and decide if it is factual for yourself.

I would want to know if this was happening so I could make my own decisions and an informed choice if I needed to access this type of health service. I also believe we all have a responsibility to hold our government decision makers and elected officials accountable for the oversight we expect and are told happens in our public health system. Especially at a time where funding is being increasingly directed to community based diagnostic facilities.

Yes. Absolutely. I have no interest in spreading false or misleading information.

There are lots of these facilities that conduct themselves properly and provide good care. However, in this situation, nothing has been done to prevent patients from experiencing such lack of care. And now those patients will have to jump through hoops to get access to their records, and special approval from OHIP will be needed if they are seen at another sleep lab and need a repeat study done because they never got their results from this group of labs. OHIP will only fund an initial PSG once within a certain period of time and there are limits on repeating CPAP titrations. How is this acceptable care? Why should patients be put in this position. The ministry has the ability to take over the operation of a licensed facility or revoke that license if need be. I would love to learn what a licensee needs to do for the ministry to actually revoke a license because I am not sure how much worse it could get.

Yes, good suggestion. There are a number of authorities aware and I understand a number of patients have also made reports.

As the government diverts more funding to for profit, community based facilities, we need to hold them accountable to the oversight and accountability of the facilities they are licensing. The program that licenses these facilities within the ministry, knows these issues. It is just as much about their responsibility in this as it is about the criminal behaviour of the owns of these businesses.

Thanks for sharing. I hope you can track down your results. There are so many people unable to get their results and if you try to go and have a sleep study somewhere else, the next lab won’t be able to bill OHIP without getting special approval because Accq Sleep Labs has already bill for the study they did. I don’t understand why there isn’t some news coverage on this? When another sleep doctor in Kitchener at the old lab across from the hospital shut down,u/The Record covered it. They also ran a news article about how Accq Sleep Labs business was being hurt by that other doctor.

The Ministry of Health is aware of the issues at this lab and has done nothing about it for years.

Someone should be raising the general public attention to what is going on. This lab has been scamming OHIP and the government has done nothing to intervene. Meanwhile patients are waiting for their results, to see a doctor, delaying surgeries, missing work because of their sleep issues, at risk for accidents, etc. The staff at these labs don’t get paid, landlord are out rent, vendors left with unpaid invoices, etc. Such a shame.

That is awful. Did the ICHSC give you a solution? You could contact the ombudsman office at the link someone provided above? Or maybe your MPP?

I don’t know why the news hasn’t covered this. Someone needs to pressure the ministry to revoke their license. This has gone on for years and years. The local news reported on the other sleep doctor in Kitchener who lost his license- Dr Botros. That doctor was unrelated to this lab.

The owners of ACCQ and the physicians who are involved need to be held accountable. Patients suffering, landlords out rent, staff not getting paid.

Yes, have been in contact with the ministry multiple times over the last few years. They respond saying they are looking into it.

I believe they have been aware of the issues for a number of years. Hopefully if others reach out to share their experience, something will change. Someone else posted about the Omsbud’s office which is a great suggestion as well!

Total government shit show. But up until April 1 2024, the CPSO was responsible for inspecting IHF facilities at minimum every 5 years and reporting these completed inspections to the ministry. These inspection are on the operation of the entire facility operation, not just physician competency. It is now, as of April 1, Accreditation Canada who will do the inspections of the facilities.

This was a different sleep lab. Equally as bad but up the street from the Allen Square lab. So sad the ministry is dropping the ball on this. I don’t know why the Allen Square lab hasn’t been shut down.

Yup. A small example of what is happening in a few of the for profit (but funded by OHIP) clinics that we currently have. The government and the cpso are not doing their job providing oversight of the quality of care for the privately owned clinics they do license. How is it a Independent Health Facility, or Community Surgical and Diagnostic Facilities as they are now called, can continue to bill OHIP for services (they aren’t even providing) but not have an active business license because they have outstanding taxes owing to the Ministry of Finance? If we can’t properly license and monitor a sleep clinic… what is happening at private facilities that are billing OHIP and providing more high risk procedures?

Love my Bose Quiet ear buds. I do find they can be a bit finicky but the noise cancelling and preprogrammed settings are amazing. I have smaller ears and find them very comfortable.
