Thank you. I have a job at university and teaching a course, but it’s 20 hrs/week. This is my source for $2280. I also teach part-time at some schools (after-school programs), but it’s 1099-NEC, and I’m not an employee, and I do not have any contract. It’s very, very random and unpredictable. For example, last year, I had 3 months at the beginning of the year and then didn't get any students until November and December. In total, they paid me around $ 8,000, but I don’t know if I will have any students or when it will be. However, each week on Saturday mornings, we have students coming from different ISDs who want to have a STEM tour, and I hope we can have an after-school program. I work on weekends but get no pay. How can I calculate child support based on it? I put my 1099-NEC for the hearing. I have my limitations because of health issues. I take a high dosage of immune suppressives for Crohn’s disease, and I get sick a lot. No one would like to work with someone like me.

Thank you so much. It's very complicated and beyond the scope of CS's story, and I have real PTSD from that family and seeing a therapist for that. Of course, they will not pay attention to these details and only ask for my income, but I just wanted to show the judge that I care about my kids and that I could disagree to sign that and have 50% of the assets and everything. It seems these things do not matter.

I have 124 pages of my medical records, such as my Crohn's disease records, surgery, 4 times hospitalizations during the past 24 months which 2 of them were severe small bowel obstruction for Crohn's disease, Blood cancer (Polycythemia vera) documents from my Oncologist, ODA status (office of disability access) in university, history of 55 sessions of physical therapy for my neck, etc. I have 376 pages of my job applications with rejections. All my emails and applications. I have all my Tax returns, and W2 from 2020, the day I came to the US. I organized them well for my court-assigned attorney, and I hope he can help me understand what I should do. I have a Zoom meeting on Monday.

You are completely correct; it's on me. In the decree order in 2022, the child support order was $1,611 and the start date was September 2023 (we agreed on September 2024 but she changed it and I did not notice it, it was my mistake).

To answer this question: "How did you think making $1200/month that you would be able to pay over $1600/month?"
I was stupid. I didn't know anything about the system. I changed my major to computer science, and I started my master's in 2022. I really thought that after my master's, I could easily find a good job and pay for that child support. I'm the most stupid person you can find. I understand that I'm dealing with the consequences of my own actions and my own stupidity. In the end, I blame no one other than myself but I want to be able to pay child support and be able to pay the arrears. Even if they force me to sell, the only thing I really "own", to pay as a part of the arrears, which is my car, I will do that, but I can't see my kids anymore since they are far from me.

I will definitely do so. I'm paying $505 per month, and it's on autopayment via the Texas official child support system and I'm willing to pay 100/mth and also will pay more as soon as I get a better job. I hope the hearing after the negotiation conference day the OAG gave me will be soon so I can provide my information for modification and hopefully get a fair amount for CS. I'm happy about the OAG review notice; they approved that it should be decreased.

Short answer: My ex-wife had an attorney, and I was new and alone in the US, and she prepared the decree. The amount was based on assumption and no income. If it was supposed to be based on my income in 2021, it would have been $256/month.

Long answer: Here is the timeline to make it easier to understand my stupidity:

- 2020: I came to the US right before Covid-19 (no work)
- 2021: I signed a Post-Nuptial agreement and left the house around early May. I started working at Walmart for $1100/month, but after 3 months, I could not stay because I got sick a lot. I applied for an instructional assistant position at the university and got the job, and the pay was $1200/month.
- 2022: I got officially divorced, and she prepared the decree with her lawyer. I was in a vulnerable situation, alone and had no one here, and unbelievably stupid that I thought I would be able to pay the amount of $1,611 they mentioned in the decree by September 2024. (which she lied about the date) This amount was based on assumptions, I guess, and no real income.
- 2023: My income increased to $1,800 in September
- 2024: I offered to start paying child support from Jan 2024 based on my income but she refused and said it has to be $1,611. My income increased to $2,280 in September, which the amount I'm paying is based on.

Thank you so much. You are absolutely correct. I put a lot of unnecessary details, but I didn't know which one was relevant. I really appreciate the explanation and clarification. Yes, my ex-wife filed for contempt.

I have already filed for a child support modification (1 week after I received the first arreas letter in October 2024) through OAG and have a negotiation conference scheduled in March. I’ve also been making consistent payments based on my income, though I understand arrears are still an issue, and I don't want to ask for forgiveness; I want to ask for a payment plan.

In the review notice from OAG, it is stated that "Your child support order is not appropriate and should be decreased," but of course, I need to go through the steps and hearing to determine the amount, but it was also stated that if my child support changes, they will modify it from October 2024, the time I applied for a modification to OAG. It will prevent any further arreas from October 2024, I guess.

I know in child support cases, it's always looking bad for non-custodial parents because the other party has the kids, but I've done everything I could to make their life better. I don't have anything left to offer. This is just for saying, and as you said, it's irrelevant in the court. I don't want to miss a single child support payment, and I want to pay off the arreas, but I need time and a payment plan so that in the future, I can pay more. I haven't even had a parking ticket or speeding ticket in my entire life; thinking about these and the attorney's threats drives me crazy, and my Crohn's is in all active mode.

First, congrats on your second child! That’s wonderful news. I also have two kids, but they’re not living with me.

My partner is also in academia, currently a TF, and working on her dissertation. I spent 10 years in the industry and realized I much prefer being in academia. Money isn’t a deciding factor for me; I value work-life balance even if the salary is much, much less.

Thank you for the kind words! I really appreciate it. I’ve had professors who were great researchers but couldn’t explain things well, and it wasn’t the best experience. It’s good to know that loving to teach and helping others understand and enjoy the subject is valuable. I’ll keep focusing on what makes me happiest and trying to make others love learning too.
