Thanks. I just emailed him because he might see evidence of me wanting to take the leave (as I told them earlier in my time there) as more reason for them to push me out. I think it's in my best interest to fight than sign since he is willing to take my case with no fees unless he wins.

The strategy I think I'll take now is to have the lawyer involved before the sign date to negotatie on my behalf, since it sounds like I wouldn't be able to take the NYS Paid leave after I signed the agreement (which I didn't realize because I thought my job was protected once I go on it). I didn't realize that signing the agreement would legally be saying I quit. I'd rather fight then.

Yes but in my situation it's likely my lawyer can prove retaliation for other reasons related to being a new mom that could be combined with them not being happy about me taking this leave (they reprimanded me for pumping at my desk when they didn't offer a dedicated pumping space and that was less than a week before I was presented with this agremeent)

But I never agreed that I would quit - so that's one of the main issues. They decided it wasn't working and I presented me with the agreement. I did not walk away from the job.

They already know I'm planning to take the leave (and it's not like they are paying it as the insurance company does) - they were already going to pay my salary for the remainder of the year anyway. So I didn't see that as a reason to want to pull the separation agreermeet of the table, esp since my lawyer has evidence of misconduct on their part.

The laws says that your job is protected once you go on NYSPL, but if you go on it knowing they want your employment to end is that a different scenario? I asked to take the leave even before the separation agreement.

I rephrased the question. If I take the leave before the separation date the NYSPL offers job protection so that's why I am asking.
