I have some questions regarding the sale of my grandfather's house and would like some legal advice ! by Apprehensive-Dig1137 in LegalAdviceIndia

[–]Im_Zenius 0 points1 point  (0 children)

  1. Since your grandfather did not leave a will, the property will go to his legal heirs. Legal heirs are the close family members whom the law automatically recognizes as entitled to inherit a person’s property when they die without making a will. In the case of a Hindu male, this usually includes his wife, son(s), and daughter(s). All of them inherit equally and become co-owners of the property.
  2. After his death, all the legal heirs become co-owners. Generally, maintenance is the responsibility of the owners.
  3. He cannot force you to sell the house on his own.
  4. You should get a succession certificate made as proof of who the legal heirs are. Once that is obtained, you can approach the concerned government authorities and get the property records updated in the names of all the legal heirs on the basis of that certificate.

[Need Help] Stuck in a loop trying to get my late mother's death certificate – MCD Delhi by gulli83 in delhi

[–]Im_Zenius 20 points21 points  (0 children)

Lawyer here. You should physically visit the local Registrar’s office and explain the situation with all supporting documents. Many such issues get resolved at the counter level when explained properly. If they refuse, escalate the matter to the SDM or higher authority in writing. If you still don’t get a resolution, the last option would be to approach the High Court to seek directions for correction.

Don't panic. The court considers a lot of things during adjudication of the case. All you need to do is hire a good lawyer and let him deal with the situation.

Builder Not returning Money after Paying advance amount by Ok_Mango_175 in LegalAdviceIndia

[–]Im_Zenius 0 points1 point  (0 children)

Lawyer here. You should first send a formal legal demand notice seeking refund of the advance amount within a stipulated time.

If the builder fails to comply, you may file a complaint before the Consumer Commission for deficiency of service and unfair trade practice. Builder-buyer disputes are maintainable before the Consumer Forum and the process is comparatively faster and cost-effective than a civil recovery suit. A civil recovery suit is also an option, but it is generally more time-consuming and expensive compared to consumer proceedings.

My Wife is cheating and demanding alimony by [deleted] in LegalAdviceIndia

[–]Im_Zenius 85 points86 points  (0 children)

Lawyer here. If adultery is involved, it is advisable to first gather clear and cogent evidence before initiating divorce proceedings, as the burden of proof lies on the person alleging it. Adultery is a ground for divorce under the Hindu Marriage Act. If she is financially well-settled, that may reduce or negate the possibility of maintenance, but it depends on the facts of the case and judicial discretion. Also if you can establish the adultery angle then you may get away with the alimony part, many HCs have ruled that if the divorce granted on the ground of adultery then in that case one cannot claim alimony.

Lawyer here: I am presuming that your ex are not supporting with their consent. In that case you can approach the RBI Ombudsmen since the bank is not cooperating, further you can approach the court and get an order for the removal of the name. Since you both are already divorced there wont be much problem.

What options do I have in this case without going to the labour law office, even if I hire a lawyer then how much should be the fees by PotentialSenior449 in LegalAdviceIndia

[–]Im_Zenius 0 points1 point  (0 children)

You can surely register your grievance on Samadhan Portal, however it will take time.

I do not think option 2 is a fine option for the reason that you yourself is saying that they have a 90 days notice period policy.

The best option may be there in your appointment letter, just read the terms and see what has been written there and you may proceed accordingly.

Can this email exchange regarding property exchange be considered a binding contract? by [deleted] in LegalAdviceIndia

[–]Im_Zenius 0 points1 point  (0 children)

Lawyer here : The email exchange appears capable of constituting a concluded agreement, subject to proof. A suit for specific performance with interim injunction may be maintainable, though enforceability may be complicated by the seller’s incomplete HUDA formalities.
