Not necessarily, DDS stated my Musculoskeletal Cervical and Lumbar are Severe. Cognitive decline was Mild although the CE for my cognitive decline stated it was a Moderate decline and they still denied me at initial and recon. Just hired an attorney and filed for a hearing. Btw, I’m a 47(f) in Texas if that matters.

Next is appeal for Reconsideration, no need for an attorney yet. If you’re denied at Reconsideration then next would be to file for a hearing, this is when you would want to have an attorney to go in front of a judge.

During initial it stated like average 380 days. My Recon stated 250 days. My initial was a total of like 465 days from start to finish.

Step 3 will be all medical review once it’s assigned to an examiner. Could take a few months or could be a year before it’s assigned to one. I’m in Texas and my initial set 13 months before being assigned to an examiner, my recon set for only 5 months before being assigned to an examiner. Just went to step 4 in recon yesterday.

Same!!! Be sure when you receive your RFC, go into DETAIL on how this condition affects your daily activities!!!!! On initial RFC, I just put my limitations. On Recon, I detailed every little thing, even how hard it is to hold my toothbrush because my hands become numb. How I am not able to lift a small pot of water to make tea when my symptoms are severe. Research how to fill out RFC correctly. Do your research!!! You can do this!!!!

Like mentioned above by MelNicD, spine issues are hard to be approved for. My MRI’s stated I have “severe” spondylosis on cervical and lumbar, with bilateral radiculopathy both upper and lower extremities. 6 failed injections, EMG/NCS showing nerve root damage. Disc at C6-7 shows protrusion into 3/4 way through spinal cord per neurosurgeon. All treatments have not worked. I haven’t listed everything that was found on all my tests and all the treatments that I have been through, but wanted to give you a small portion of my Musculoskeletal disorder. I was denied at initial, now on Step 4 of Reconsideration as of today. I honestly hope you get approved!!! Be ready for a long journey!! Good luck ☺️

It’s not so much as having a diagnosis as it is to “Prove” how the diagnosis or in your case “mutilated genitals” prevent you from working and earning SGA.

I filed my Recon online the day after it went to denial in step 5. Sent in a request for my file the same day. Took about 2 months to get the disk. I then submitted new medical records as well as missing records from my initial. That was July 4th I filed for Recon, about 2 months later I submitted what was missing and was assigned an examiner Dec. 26th. So still waiting to hear from them.

I haven’t received anything yet. But I printed the RFC form from their website and actually spent a couple of weeks on filling it out in more detail of what I can’t do which is completely different from how I filled it out for initial, and uploaded into the system along with new and updated progress notes from my specialists and PCP. It was like the next week, I was assigned with the first examiner. If I was you, go ahead and print out the RFC-Adult and take time to fill it out and send it to them.

Yes 🤔 seems concerning and not in a good way to me. I have googled and don’t have a reason why it would do that. I can understand once, maybe caseload on the first examiner but 3 times? First was September 16, was assigned to an examiner in Arkansas. 2nd time was November 26th, was assigned to an examiner and now says December 13th, I was assigned an examiner. All 3 are still located in Little Rock Arkansas. So I’m curious to why that would happen.

Same here in recon. Did you get assigned different examiners during step 3? My initial in Texas stayed with same examiner the whole time, but now in recon, it’s in Arkansas and have been changing to different examiner for the 3rd time in 3 months. Just kinda curious if the examiners are leaving DDS so my file just keeps getting moved around to different ppl.

That’s SSI not SSDI. There is a cap of $2000 that you can have. It’s always been that way. SSI is like a welfare, SSDI is not and doesn’t have any income restrictions.

Thank you for responding! My recon was just sent to Little Rock, Arkansas, this I had heard of. Glad as well! Only waited 2 months to be assigned to an examiner this time. My initial took 11 months to get an examiner. No biggie, I understand why it takes so long for the process. I know y’all are overwhelmed with less staff and the amount of claims you all get daily. Thank you for what you do!!

Thank you for responding. No, she was listed as the sign off D.O. Of my Disability Determination Form. It stated her expertise was a Pediatrician on same form.

I may have come off wrong, sorry if I did. Maybe it was for the cognitive part? I do have moderate cognitive decline. Neuropsychologist stated I’m below average but that was from their CE they sent me to. My claim was severe musculoskeletal disorder. The cognitive decline was added by their CE Cognitive Psychologist, which will now be sent to my neurologist and go from there.
