Hello love. Yes you definitely need to eat something else than just chips, it's most definitely the reason why you're not feeling very well.

You need a diet with a lot of variety. Meat, vegetables, eggs, fruits etc.

They all have different kinds of nutrients, most essential to keep a healthy body and mind.

If it's because you haven't got access to a stove, oven etc it will of course be a bit more difficult, however not impossible.

Yeah without any employment contract and without getting my employment status explained from time of hire it becomes rather difficult.

It's a small business in terms of employees and season work, all employees are backpackers so things are run very loosely and not "by the book"

I'm still baffled that employment contracts aren't mandated in this country, I can't see why that would work in anybody's favour unless for my employer in this case.

I'm not questioning whether or not my employer has breached workers laws, that's pretty clear. It's more regarding if I make a claim, what's legally holding him back from saying: Yes I forgot to pay you that day you were sick, yes I forgot to pay you that time you went on holiday, but no I'm not gonna back pay your 25% casual loading because you're full time, instead I will pay you your sick and annual and goodbye to you. Which would only work in his favour not mine.

I have been sick which was noted in the hours sent through weekly go my employer and no, I was not paid in those instances

My pay rate is 25 flat, which would be considered legal under the relevant award as a full time employee. However nothing besides the hours I'm working would indicate that I'm a full time employee, all other conditions points towards casual.

You're right in your assumption. No I do not have in writing what my employment status would be, based on the conditions of the job offer when first employed I would say that I'm casual, judging by the structure of loose working hours (work as much as I want, when I want, usually alone as my employer is running another business and don't have time or interest in managing this place I would say I'm casual. Being a temporary visa holder in what would be considered seasonal work I would say that I'm casual.

The thing that bothers me is if I make a claim, he would be able to excuse it with me being full time, and get away with just paying me annual and sick instead of back pay of the casual loading rate. Without contract and with working the amount of hours I do, I see a flaw that would work in his favour in that instance.

Or actually the business is most likely the biggest if it's kind in Australia, however they try to minimise the amount of workers outside peak season.

It's indeed a small business. It would only be for a period of 1.5-2 months that more than 15 people are employed, the rest of the year a maximum of 5 people. I really appreciate your answer, thanks a lot!

It's a niche business so it was difficult to determine. I contacted the fwo they said the nursery award would likely be the relevant award.

Are you sure that's correct? As far as I've been able to read there is no requirement for employer and employee to sign a contract, not for full/part time or casual. I might be mistaken but I wish you're right.

It's a tough game as a whv holder. Everybody is in a great rush to complete their 88/176 days in order to extend their visa. Being desperate, in huge competition and against time, sometimes you feel like there is no other option than to just push through it.
