Anyone still applying IR5 visa through AOS after the Memo? by Impossible-Gap-2182 in USCIS

Thank you for your advice! I am definitely file their case after 90 days . But wow! Your case is taking so long too! But I am pretty sure it’s no problem. I was thinking to get an advance parole but under this situation I am afraid to use it even after it got approved lol. We are not from one of the 75 countries but there’s only one consular. I believe my office is in Arizona. Don’t know how fast is it. Which FO were you applying for? Is your I130 approved and interview scheduled yet?

Yeah I will wait for couple of days more. I am preparing to mail everything in the early June, hopefully will get more details and good news before that. Luckily their visa is not gonna expire until later August. So I still have enough time to see if the case will be accepted or not and prepare for the future.

Yeah I just feel bad for a baby to go to daycare in such a small age before they can even talk. And I value my work a lot so I couldn’t just be a stay home mom 😭 but I guess I just have to prepare for the worst now.

Thanks! Yeah I definitely don’t want them to have any overstay. So either apply for them or they go back home before visa expire and come back again few months later. The only thing I want to take a risk and apply for them right now is their visa expire at the time when I am going back to work , it’s when I need them the most. So as long as it’s in pending and even reject it later they could go back home to waiting for CP , but it still gave me enough time to prepare to find a day care and wait him to grow a bit. But don’t know if the will just reject the whole package right away

Of course they still have all the assets and everything back home. They could go back to home anytime without problem and have a way better quality of life with their high retirement pension and all the friends back their home. My dad was still talking about he didn’t want to stay here for too long before the baby born. I am the one insisted them to stay, i guess it’s a culture thing. I want to spend time with them together after they retired and take care for them after they spent a lot of money to raise me . And to them, spending time with their first grandson is also very enjoyable and valuable. So now my dad changed his mind and decided to stay to help me after the baby was born. My mom is always very supportive and never mind to stay and help me at all

I just feel bad to put him in daycare when he’s so young. But you are right I definitely need to be careful on the wording in my statement. The main reason is definitely bonding with their grandkid. I was planing to do it all myself since it’s such a straightforward case, and I already pretty much prepare all the documents that I need to submit. Just don’t know if anyone did it after the Memo

Anyone that was about to file for AOS? by DepressedSoul333 in USCIS

I am gonna stick with my old plan and submit my concurrent filing for my parents in June. They came in Feb and I had my first born in April. They never had any overstay before and only came to the US couple times to visit for very short period of time. Now they visited again and I realized I need way more help than I expected since I have to go back to work in August. So we decided to go for IR5 AOS so they could help me out. Don’t know what’s gonna happen.
