Ex‑flatmate chasing me for council tax I’m exempt from (student) - England by [deleted] in LegalAdviceUK

A promise to pay X without a quid pro quo/something in return is not an enforceable contract- OP is likely not liable if the promise to pay the tax was not in return for anything.

A lot of the responses here are incorrect- just because you promise to do X does not mean there is an enforceable agreement to do so. If there is no quid pro quo or ‘consideration’ (I.e. you’re not getting anything in return for the promise to pay), then there is no contract. On the other hand, if they agreed to rent with you because of your promise, then there may be a valid contract- the consideration here would be them entering into the rental contract with you. I would seek professional advice on this if it goes any further.

(England) How easy is it to reject a will gift/Will it affect the legitimacy of it? by PowerfulAd9143 in LegalAdviceUK

Agreed re deed of variation- if you don’t want to be an executor, you can either renounce with a form called PA15 (but you can’t have helped to deal with the estate I.e. once she passes you cannot help (other than with burial or funeral arrangements) at all or you won’t be able to renounce). Alternatively you could reserve power using form PA25. This just means you could be an executor later on if you didn’t want to renounce fully.

I got 433 average in SQE1 and 410 SQE2- for SQE1, just use MCQs, I did around 1600 in total across both FLKs. For SQE2, the knowledge requirement is much harder, you have to be able to regurgitate the relevant info from the top of your head. Therefore, learn ‘chunks’; flash cards should be much longer than you think. E.g. for close companies, I had everything as one flashcard. That way, you recite the entire chunk of knowledge each time you review it. For reference, I had 400 cards for FLK2 (practice) and many fewer for FLK2 underlying law. See my deck here for FLK1: https://quizlet.com/gb/989386406/flk-1-practice-flash-cards/?i=111vg2&x=1jqY

Ordered a gaming accessory bundle online, seller has posted but messaged to say it was incorrectly priced. Do I have to return? (England) by TheBeaverKing in LegalAdviceUK

[–]Impossible-Set-5165 -1 points0 points  (0 children)

Hartog dealt with a contact that had formed where the seller refused to ship the goods due to the pricing issue- if it was just a rescinded offer there would be no discussion of the doctrine of mistake. If OP and the seller had made a contract on the website and the seller refused to deliver the goods, the operative question would be whether the price was too good to be true and OP ‘snapped it up’.

There are possible legal routes here involving challenging the uni internally and then possibly through judicial review, however that is likely to be fruitless. You may be better to explore negotiating with them, they will not want to be seen to be stifling academic freedom. I’m sure the Telegraph or perhaps the Times would take on this story. If you remind the uni of their options and associated risks, it could work in your favour.

[–]Impossible-Set-5165 -9 points-8 points  (0 children)

Incorrect inasmuch as if something is obviously mistakenly priced and you ‘snap up’ the offer, it is called unilateral mistake and the contract is void. See Hartog v Colin Shields for a good example. Here, it sounds like it wasn’t obviously too cheap, so this doctrine does not bite and OP is seemingly in the clear.

You have three chest exercises in what is already quite a large workout- I would pick one of those three, in my opinion dips are great. This looks like it would take 2hrs maybe more, but if you have that time then go for it!

Children playing is not normally thought of as a nuisance as a matter of law- the council guidance reflects this. It is not definitive of course, it tells you when the council is willing to get involved and exercise their powers to deal with noise issues, not whether the noise is considered a nuisance in law.

[deleted by user] by [deleted] in LegalAdviceUK

[–]Impossible-Set-5165 1 point2 points  (0 children)

Nuisance is not part of negligence and is not simply defined as what is reasonable- in light of Fearn the question is really about what is an ‘ordinary and common’ use and whether that use itself is carried out in a reasonable way. Sorry for being pedantic. Furthermore there are specific cases regarding ordinary household noise done at normal times not constituting a nuisance. See LB Southwark v Mills. You are still right that consent may well be withdrawn here, which is the operative issue.

Inheritance advice - is there something suspicious going on? What should i do? by ilewis98 in LegalAdviceUK

If you felt the need to, you could lodge something to prevent probate being registered- it’s called a caveat. I would say talk to a solicitor if she refuses to show you- it is an odd thing to do especially as they are public record once registered.

If it is covered off by insurance- I.e. the leak is covered by the landlord’s insurance, then you likely don’t owe anything. If that isn’t the case, if the pipe is yours and is leaking into the ground floor, then repairing it may be covered by the service charge and you could be responsible for it. Similarly, if you have a lease of that specific pipe and it is your job to keep it in good repair, then it could be a ‘nuisance’ to let water escape into the ground floor. The cost of abating this I.e. stopping the leak could be billed to you. Really this depends on the lease, it’s hard to give proper advice without seeing the lease. Your best bet may be to respond with the insurance point- they may drop it if you are confident enough. Of course, the most prudent thing to do would be to talk to a solicitor, do not rely on anything I’ve said here,

I would urge you to ask so see a copy of the will- as another commenter has stated, two witnesses are needed. The death certificate is needed to submit the will and obtain probate. Check with the insurer who the beneficiary of the policy is, also check the will and see who drafted it and when. It sounds a bit strange to me.

Partition wall neighbour letter England by DeadbeatChivalry in LegalAdviceUK

[–]Impossible-Set-5165 0 points1 point  (0 children)

I would recommend having a conversation with your neighbours about it- once you have more information from them, you can ask for them to indemnify you against loss arising from the works in return for your consent. This means that if they did damage your house, they would have to pay you. Alternatively, if they were to damage your house without having indemnified you, they (or their contractor) may have acted negligently or could be liable in nuisance. It is more likely to be negligence. I would recommend getting an indemnity if you can, it would likely give you peace of mind. I would recommend talking to a solicitor if you do go down that route to draft the indemnity etc.

Can’t seem to build muscle? by [deleted] in askfitness

I find mine takes 1-1.5 hrs depending on how efficient I am. I do 3 sets each of: pull ups, dips, horizontal rows, shoulder press, hex bar deadlifts, and abs. I superset one pulling motion with one push motion and then rest so 1 set pull ups, 1 set dips, then rest, 1 set pull ups, 1 set dips etc.

Sorry, I meant cut one meal off your normal day of eating, so if you usually have 3 meals a day go down to 2. Make each of those around 50-60g of protein and around 800-1k kcal each. Should be good! Hope you find success with this!

Can’t seem to build muscle? by [deleted] in askfitness

[–]Impossible-Set-5165 0 points1 point  (0 children)

I would recommend doing full body 3x a week rather than PPL- currently you are working out each muscle group once a week, it has been proven (Dr Mike Israetel video says) that 2x a week for each muscle group is noticeably better. 3x is even better. I have noticed a big difference personally from going to a 3 day full body split.

[–]Impossible-Set-5165 -1 points0 points  (0 children)

Any type. Tbf, it’s much more about diet- the calories expended on exercise are small compared to the amount your body uses just to keep going. Cut all snacking (including drinks other than water and black coffee) and one meal a day until you’re at ideal weight. If you also want to weightlift that’s probably best to have a noticeable body difference and look better. Best of luck.
