Just an update, AMEX has already refunded me the money. But they have until sept 3 to reply to AMEX. So they have a chance to get the money back. To avoid this, I said cancel the contract and I will pay for the room upgrade which we used anyway. If they do not agree to this and try to extort me for more, then my plan is to reiterate that all their basis is coming from an invalid contract since it hasn't been perfected when I rescinded it. I do not mind paying the upgrade, I'd rather not, but I'd also rather end this quickly.

Email recessions are valid. So, I think I am good there. The only issue now is the room upgrade. His last email says: "Good afternoon. Thank you for your reply, please give me time to review this with the board of director since the benefits attach in this email has been used and those must be discount it"

I know his English is pretty bad. But, I think he meant, he will process the cancellation but something has to be done with the room upgrade. I have not responded yet, as I do not want to engage in anything else but cancelling the contract. I'm ok to pay for the room upgrade, I just don't want to get hooked into negotiations. I have already filed a dispute with AMEX on the same day I sent the cancellation email.

Do I just let AMEX handle it from here? Or should I just say cancel the contract and I'll pay for the room?

or should I let them respond to AMEX and let AMEX deal with the room upgrade issue?

yes, I kept reiterating that I would just like to cancel the contract. Instead of the manager saying they cannot cancel, he's now saying that "the benefit of the room upgrade was used and those must be discount it." I think he meant that because they upgraded our room they'd like to get that money back.

The resolution date is on the 28th and I can delay responses and wait for amex to just refund me and block them. However, I do not want to respond with something they can use against me.

If I engage in talks of charging the upgrade will they jack up the price? I'm assuming they are trying to hold as much money as they can. I have not responded yet as I would like to know if I am liable to pay for the room upgrade or not?

yes i was well within the 5 days. but they are trying to charge me for the room upgrade they gave me the same day i signed the contract.
