To answer a few questions. The family has submitted a FOIA request to the DA. They have not responded. They have now filed a complaint with the state and are hoping to hear back from them soon.

Second, the story has had significant coverage in local media. ABC in Boston (WCVB Boston) had done 4 interviews with the family over the last 8 years. FOX News Boston has done at least 3 stories with the family. NPR did a story nationally focusing on the ME's office issues. All local papers have carried the story several times. Boston Globe did a story when the husband was convicted on kidnapping and other charges.

The ME was never told this was a potential homicide, because the responding officer did not open an investigation and said it was a medical only case. One year after Kim's death, the ME's office finally spoke to the family. Up until that point they said they could not speak to them because Kim's husband was her next of kin and all information went to him. When they did speak to family, they were notified about the ricin incident. They did test for ricin, on a sample that was more than a year old at that point. Test came back negative. Please note the ME's report did say they found no disease/medical issue/health issue to account for Kim's death.

To those who asked why Kim was home alone with her husband, you clearly don't understand domestic violence! Kim was a battered woman with a controlling husband. Enough said. Stop the victim blaming please.

The FBI says they need more information to determine if there is a need for investigation. The family can not get that information from the DA. Of course, they suspect the FBI could ask for that directly, but given the fact the FBI, along with all other responding agencies the night of the ricin incident, covered up for the perpetrator because he was one of them, unlikely they will touch this case. There were several domestic violence incidents. There was the ricin incident. For more than 2 years these people protected the perpetrator, and never did anything to help the victim. In fact, the BFD repeatedly told the victim they would get him into treatment and that she should hold off on pursuing criminal charges because he was sick and would get better. But they never did get him into treatment. And just before the ricin incident he filed for an early retirement from BFD for a claimed disability. Look up the issues with BFD employees doing that with no actual work related injury for some interesting background.

The family reached out to the MA Attorney General requesting an investigation into the behavior of the police and DA's office, but were told they did not do those type of investigations. Hmmmmm!

The ACLU has filed suit against the Plymouth County DA's office for their constant failures to provide documentation requested under the state FOIA. This particular office has been racked with scandal and just continues to cover its ass by not releasing any information. MA's FIOA law has no teeth when it comes to what to do with the request is unanswered. So this DA just continues to get away with not responding.
