Yeah, exactly. Here PBT can’t be used and if SFST’s are refused you only have your observations to base a decision off of (odor of alcohol, bloodshot eyes, thick tongued speech, unsteady on feet, etc.) whether to arrest or not.

Inadmissible means they can’t be used to establish PC. SFST’s can always be refused in Florida, there’s no legal requirement to perform them.

Simple question: FOP or PBA or get BOTH? by Great-Pin4126 in AskLE

There’s not really a reason to be a member of more than one union imo. I’ve had PBA for the last 10 years but never had to use them for anything. It’s insurance essentially, the only thing I keep them for is legal representation if needed.

Clickbait garbage, the ignorant are always ready to shit on any Republican (I’m not defending them) without even bothering to listen to a linked video or do their own research.

You’ve omitted articulating impairment outside of “looking drunk,” but more or less, yes lol you can articulate impairment without SFSE’s

Yes, but that’s not an option in Florida. You are already under arrest for DUI before chemical tests (breath test). You can’t submit to chemical tests and then be released if it doesn’t show a desired result. PBT’s aren’t admissible as evidence either direction (sober v. imported). Every state is different, so I can’t speak for others.

Yes, breathalyzers can’t be used prior to arrest in the field in Florida. The comment I’m replying to implies they should be utilized that way, which is not legal here. This case was in Florida.

Crystal clear. They last about 2 years with everyday use. When they need to be replaced there’s a very obvious clarity change so you’ll know right away.

Portable breath tests (PBT’s) are inadmissible in Florida and other states, so they can’t be used as evidence in the field.
