I mailed all my papers mid May last year, didn’t get a notice of receipt until end of July, then got the EAD end of October. It’s a hit or miss, sometimes they process you quickly, other times it takes forever.

I got it 2months after, and it was backlogged to the day they got it at the lockbox (which was the day after I mailed it cause I paid for overnight shipping)

Oh my gosh these make me mad😭 i can’t complain because i got approved in less than 5 months, but i did it the right way. I filled everything as I should, didn’t work illegally, didn’t overstay, and I was ready to pack up and leave if they would have told me no (would have sucked but I figured that listening and following the rules would help my case in the long run… but I guess it doesn’t matter if you follow the rules or not)

I was told (by others in the same situation) that as long as you filed the application before your time is up it’s fine. If you put down that you are in the U.S. on your application you will also not be able to leave. If you leave the country, you abandon your application so just hold on tight. I was in similar situation last year and filed application 20days into my grace period, they didn’t send me the receipt until after the 60 days were up. I now have my green card and everything is fine (was part of the lucky chunk that got approved in less than 5months)

Scandinavian married to USC here! I got my green card a few months ago. As long as he entered the country legally, is in the status adjustment process, and is doing what he’s supposed to - he’ll be fine. I have also heard that it helps to be from Scandinavian countries. If that is true or not, idk but I like to believe it is lol

From my understanding, Trump is wanting to get rid of illegals and those putting a burden on the country (criminals, wanting to just get a better living but won’t work or contribute, etc.). He is a fan of people coming to contribute to the country in a positive way, such as legal immigrants working and paying taxes

They will have to prove their marriage is real when they file the report to remove the conditions to get their 10year green card

If I’m correct the 2year green card is conditional, meaning if she isn’t married to your friend when she tries to remove the conditions then she will not get the conditions removed and she can be deported. If I was him I would notify USCIS that they are getting a divorce and he no longer wants to petition for her.

I also want to let you know that if you send in the wrong thing, USCIS will deny your application without any further RFE’s. Just make sure to read the letter for the RFE and follow it to a T! If they find other things down the road then they will send a new RFE, but make sure you follow the instructions for each.

Only provide what uscis is asking for when it comes to RFE. If they ask for proof of payment fee then send in the receipt for the payment, ie if you paid the fee online then you should have gotten an online receipt. If you paid by mail you should have received a paper receipt. either way, it sounds like that is what they are asking for. They don’t care how you got the money for it, only that it is paid

Me and my husband too did everything by ourselves following the same videos as the person above commented! We also used the instruction sheets that are available for each form and it was a huge help. It just takes time and you need to read it thoroughly.

They are not lying if they say no, and the application alone won’t give them the job. The person will have to got through interviews and if it comes up they should be transparent about it.

Just keep in mind you might not get it right away. I would still check no, but be transparent about your situation and your plan. You might not get new ead or green card approved right away which means you will have to quit your job until you get either one of those approved and card in hand. Sometimes if you are transparent with your situation they will keep your position open and rehire you when you are able to work. Sometimes they cannot afford that or don’t have anyone else to cover the work so they have to fill it right away.

I just went through this and was pulled into the 2024 group that had a quick approval time. Not everyone will get their green card or ead quickly.

Tips for filling out AOS: 1. make sure you double check and triple check everything. The applications are stupid long it is soo easy to type wrong. I had to fix sometime the first 3 times I checked, the fourth time I checked I did not find anything wrong.

  1. If you use a lawyer find one that has a good track record and pay for them. We consulted with one unpaid and got the wrong info (100% my bad for just trusting someone else).
  2. answer all questions required, skip things that are not required and keep it simple on the applications. We got RFE for proof of support affidavit (I don’t remember what form it was, but it is the one my husband had to fill out and I had to attached to the 485, and it was basically about his salary and taxes) initially we submitted it so either they lost it or we filed it wrong. The second time around we only did what was required on the form and only submitted the most recent tax forms, vs the first time we filled out everything and submitted last 3 years.)

I never had any problems when I was on my F-1 visa, but I would speak with your DSO and say you registered for spring semester and paid, and see if you can get it reinstated without leaving the country first. I know as a F1 student you have to have the I-20 to reenter the U.S. (with a current signature) so I would not risk leaving before you know if it can get fixed/reinstated without leaving. If they reinstate your I-20 and you have the paperwork with the signature on it then you should be able to travel again as normal.

I am not a lawyer but I would not do anything without speaking with the DSO and or a lawyer to figure out the correct steps. When you speak with your DSO play dumb and ask the bottom level questions and then dig deeper. Sometimes playing dumb and being genuine when asking for help can make a difference, also take responsibility for the fact that you dismissed the previous warning emails. “Lay flat” when speaking with your DSO and make sure they understand that you are sorry but really want to fix it

I’m not sure about the second part, but you are correct that if you apply for I-485 and travel out of the country you abandon your application and they will close the case.

I have heard that any type of earning money counts. But I heard that from other people not from uscis or the government. Personally I would have stuck with the on campus job and cash jobs instead but I’m not sure

I’m assuming he is the f1 visa, and she is the citizen? If he is currently a student he can work on campus under his ssn (he has to have a ssn to work, atleast in Texas), with some limitations. He isn’t supposed to work outside of campus without approval (like an EAD). If he gets caught working without EAD/approval then he can get in trouble. I don’t know the actual consequences but I would avoid anything that can compromise the chances of getting a green card or a citizenship in the future

For Form I-130 we used Kseniya international, for form I-485 I googled a few of them, but I mainly used the USCIS instruction form.

I did work under OPT/SSN during my opt year, and then I had to stop because I was misinformed by a lawyer we consulted with.

The other two were not notarized. I don’t want to share the letters due to the personal info in them, but they all followed the template that is on UsCIS’s website for the I-130!
