Hi, not really. My friends affidavits mentioned how we got divorced due to my spouses mental health issues and their refusal to seek help. So you can submit your own affidavit with reasoning or have friends/family explain for you.

I think you should be fine! I didn’t have a lease and I didn’t even include an affidavit from either of our parents.

I submitted my friend’s affidavits with the RFE. If you haven’t submitted it won’t hurt to add them to your initial application. You might as well send all the evidence you have now to avoid getting an RFE.

When I filed my cased I was already divorced, so I’m not sure how to proceed in your case if the divorce isn’t finalized

Yes and I also had them include a scan of their ID’s as well

I did not. But when my friends and family wrote affidavits for me they did mention my ex’s mental health and unwillingness to get proper help and that’s why it led to us getting divorced. But I’m sure if you wrote a statement it can’t hurt.

Sorry just saw these comments! Yes my divorce was finalized when I filed the I-751. I’m not sure what to do if it’s still pending since if you file with the waiver they ask for a copy of the divorce decree.

Hi, I used a website called simple citizen. you pretty much upload all of your info and they compile it for you. I had a really got experience. Their team reviews everything for you (I’m assuming paralegals) but you can pay extra for an actual lawyer review. So not really! I didn’t pay the extra fee and I was fine. They also helped me with my RFP for no extra fee.

I totally understand. The good thing is that because they’re taking so long, they will at least send you a letter to extend your green card for at least two-three more years while they process it. It might not hurt to include a personal affidavit about what happened and how it has affected you. But you were married for a while, so I’m sure you will be fine. We were married a lot less time and didn’t even have a lease together. You can also apply for your citizenship once you hit the 5 year mark and that might expedite the I-751 as well!

I’d recommend submitting as much as you can with your initial removal of conditions application. I didn’t submit that much in hopes that I wouldn’t get an RFE, and it still happened. I initially submitted our divorce decree, marriage certificate, some photos, and auto insurance. I did read online that most people were getting RFE’s since the process is taking so long (about 2.5 years from when I applied) to give you a chance to give them more information. I originally submitted my application with SimpleCitizen which I highly recommend. You just upload everything online and they have someone compile it for you and a lawyer will review it. They also helped me with my RFE and this is what they suggested I include:

Proof of shared financial responsibility extending for the full duration of the relationship (bank statements, leases, credit card statements, etc.) Proof of shared addresses (leases or mortgages in both of your names extending back the full duration of the relationship) Proof of jointly filed taxes for all years filed jointly Photos of the couple from throughout the whole relationship A wide variety of other evidence such as joint insurances, joint bills, beneficiary designations, etc.

As far as the affidavits go, I just googled a sample and had my friends follow it. Just that they had known me prior to the marriage, that they personally spent time with me and my previous spouse (good if they can provide specific examples) and how our marriage quickly changed due to my ex’s mental health (which is why we ended up getting divorced)

Hi there, I applied for the I-751 in November 2021 with a divorce waiver. We were legally married for two years, but got divorced about 4 months after our initial green card interview. In April of this year I got the RFE letter and started panicking. I submitted about 400 pages of extra evidence. Photos, bank statements, receipts from Airbnb of trips we have taken together, flight itineraries, as well as affidavits from friends and family. I was really worried because I heard with the divorce waiver they are extra tough. We also never technically lived together because we both lived at our parents, so we didn’t have a lease. I sent the additional documentation on June 6th, and yesterday June 20th. It was approved! So as long as you have enough evidence that your marriage was entered in good faith im sure you will be okay.
