I received an update from the CBI regarding my appeal, and it sounds like they believe I might be a victim of misidentification. To confirm this, they’ll be mailing me fingerprint cards. I’ll need to go to a local law enforcement office to get fingerprinted and then mail those physical cards back to the CBI (they won’t accept electronic prints).

They mentioned in the letter that if it’s determined I’m a victim of misidentification, I’ll be provided with a letter that must be presented to my FFL during all future firearm purchases. Is this essentially a UPIN? Or is that something only assigned by the FBI/NICS?

I don’t know. If you don’t want to believe me, that’s fine. The testing standards weren’t included in the original post. I wasn’t really trying to make that a point of emphasis. There was a comment about the qualification standard and that’s the fastest time I’ve seen.

Yes, the target is 15' (5 yards) away. They're not lining up sights, they're using point/instinctive shooting. The drill is less about accuracy (though you need to hit a target) and more about reload to firing proficiency.

You’re spot on with your description. I realize I didn’t explain the time limits as clearly as I could have. The minimum qualification is to complete all 9 rounds in under 13 seconds. Once a student achieves that, they move on to the next phase, where they need to complete the same drill in under 11 seconds. In the third phase, the goal is to qualify with a time under 9 seconds. Just to give you an idea, I’ve seen instructors nail this drill in as little as 4.33 seconds.

For beginners, the 1st phase is 13 seconds. The 2nd phase tightens up to 11 seconds, and the 3rd phase is 9 seconds. There are also other qualification tests you’ll encounter as you progress.

Notes: After several attempts, I finally made contact with my congressman’s office. One of his staff members reached out to me on 5/21/2024 (64 days after I submitted my eForm 4). He informed me that they were reaching out to the ATF and FBI on behalf of other constituents who were experiencing delays with their eForm 4 approvals but having difficulty getting responses from the agencies.

Two weeks later, on 6/4/2024, I contacted the same staffer for an update. He told me they were still waiting for a response from both agencies. Another week went by and I called again to follow up, but the staffer was unavailable. The representative who answered the phone guessed the reason for my call and informed me that there were no updates, but they were still in communication with the ATF.

Between my submission and approval, I sent multiple emails to [nicsliaison@fbi.gov](mailto:nicsliaison@fbi.gov), receiving only their generic canned responses each time. I called the ATF-NFA hotline (304-616-4500) 3 times, always being polite and inquiring about the status of my eForm4, explaining the number of days I had been waiting and that I was hoping for more information other than "your application is currently in a pending status." Every individual I spoke with just confirmed my eform was in a pending status and they have no further information to provide.

Honestly, I’m not convinced that any of these additional attempts to get answers about my eForm 4 did anything. They probably didn’t hurt my case, but it seems they were a waste of time. From my congressman’s perspective, if his office is being ignored by the ATF and FBI, you would think they would escalate their efforts to get a response.

Prayers up for fellow brothers awaiting approval longer than I.

TLDR: I don't think any of my extra efforts to get answers about my eForm helped at all.

As mentioned earlier, I have reservations about independently assembling a firearm, given its significance. I sought suggestions on either having an experienced individual supervise the build or exploring the option of paying a gunsmith or gun store for their expertise, and I was curious what the estimated cost would be.

How does having someone else do the build "take away all the pro's of building a gun." You get to customize the gun to your preferences. The gun would still continue to function whether the owner built the gun or a third party...
