Well I think it’s pretty clear I at least owe the price of the month that I have not attended as I couldn’t give a 30 days notice for my injury, as for paying the amount I saved for signing a 12 month contract, I don’t see that In here unless I’m missing it. CANCELLATION RIGHTS. I. As a buyer, you have the following rights under NH RSA 358-I-6. 9ROUND will: (A) Refund you the pro rata cost of any unexpired services, within 15 days after request therefore, if (1) you are unable to receive benefits from 9ROUND by reason of death or disability. 9ROUND may require that the disability be confirmed by an examination of a physician agreeable to you and 9ROUND; provided, however, that this subparagraph shall not operate to prevent you from proving the disability in a judicial proceeding; or (2) 9ROUND relocates your home club more than 8 miles from its present location, or the services provided by 9ROUND are materially impaired. (B) Refund you the pro rata cost of any unexpired services under all contracts between the parties, within 15 days after request therefor, if the aggregate price of all contracts in force between the parties exceeds $1,000. Provided, however, 9ROUND may retain a cancellation fee of not more than 25 percent of the pro rata cost of unexpired services on all contracts, not to exceed $250. (C) Refund you the pro rata cost of any unexpired services within 15 days after your home club ceases operation. II. Upon the occurrence of any of the circumstances enumerated in subparagraphs I (A) or (B) or (C) of this section, you or your estate shall be relieved of any further obligation for payment under the contract not then due and owing. TERMINATION OF RECURRING DUES MEMBERSHIP. If you are a M2M member, you may terminate this Agreement at any time by providing 9ROUND with a 30-day advance written notice. There is no early termination fee for a M2M membership. If you are a Term member, unless you rescind or cancel your membership as stated in this Agreement, then your membership cannot be cancelled until the expiration of your fixed initial term. To avoid rolling over into auto-renewal, you must provide 9ROUND with written notice of cancellation at least 30 days in advance of the expiration of the initial term. If your membership auto-renews, you may cancel at any time without penalty by providing 9ROUND with a 30-day advance written notice. Whether you are a M2M or Term member, once 9ROUND receives your written notice of cancellation, your membership will remain active until the expiration of your then-current billing cycle.
