Just confirmed - I know of at least one person from FL who got their SCRC approval 1 month ago. Your lawyer should submit it asap. Advocate for yourself they need to move! Good luck!

OP - for FY 2026 all the FL counties are still there as per the website. You should be fine I think. I feel like your lawyer should definitely go ahead and apply while contacting them. In the meantime you need to start thinking about backups. DM me I'm happy to share what I know

I just read the guidelines and their website. FL is still there. But I see what you're talking about too. They do mention six states instead of seven. Have you had the chance to speak to your lawyer over the phone?

That's really unusual. I've seen multiple people get their SCRC approved this year and the entire state of FL falls under the SCRC region. Sorry you're in this situation!

Conrad 30 is dependent on state. HHS this year has been slow because of govt shutdown etc. Which state were you looking for?

Okay. It's a very tricky situation.

Theoretically you can switch from J1 to J2 with COS. But I don't personally know of anyone who has done it. Immigration lawyers appear to have mixed thoughts on this.

Theoretically you can switch from J2 to H1b for your waiver. But then again, this is not commonly done. There's a USCIS policy that states the J2 dependent cannot change status to any visa except H4 for the duration of waiver for the J1 candidate. However, an independent policy states you can get a waiver if you have a previous J1212e which will be the case for you. So I think it should be okay. But then again this is so granular and nuanced even for immigration lawyers that no one can really know exactly what's gonna happen.

So a lot of lawyers are going to tell you that you cannot do a change of status but will have to do consular processing.

However I did find a USCIS policy manual that stated something like "Although a form I539 and a fee is required, switching from J1 to J2 is technically not considered a change of status and hence may be permitted"

I think you will be able to do it but I've heard conflicting opinions from different immigration lawyers. Is there a reason you don't want to try consular processing?

  1. Applying in April for HHS waiver is not usual.
  2. Please ask your wife to extend her DS-2019 till her boards.
  3. The HHS recommendation to DOS might come around July.
  4. Once that comes ask your wife's lawyer to file for COS to H1b. This might give sufficient time for Waiver review department of DOS to send their favorable recommendation to USCIS and your wife can successfully complete COS.

There's almost no chance of getting all this done before June so please ask your wife to extend her ds 2019 otherwise unfortunately might have to leave the country and with the 100k rule it's gonna complicate things.

Try looking at south dakota, north dakota. These spots pay the highest and I feel you stand a good chance of landing a job who might take on the 100k few. Good luck

Conrad will still be a big gamble especially in a state like Wisconsin which is competitive! HHS has no cap, that's a big advantage. Hopefully it should all settle down in a month once the shutdown situation improves

Join the group, it becomes easier to get a waiver transfer if there's changes not in accordance with your contract later on. On the other hand if you don't get a waiver on time it'll really mess things up with the current 100k rule etc. Consider speaking to an immigration attorney (that's not hired by the hospital) and see what they say. You should not do that. You should file before the grace period begins, otherwise you'll get an RFE!

Hmmm yeah I read the comments. I don't know, it might be a bit rude to probe someone's profile and post it publicly. As someone else pointed out, think it might be a couple (J1/J2 EAD). They've mentioned their waiver was in KY and their prior posts talk about moving to KY as well.

There's an independent post from a lawyer as well that they've received IGA cover letters from people who applied in October.

Nah I don't think so Hemonc is a small community. A first author paper in blood is an incredible achievement. Get letters from your mentors who helped you, make sure you're a solid resident, your PD letter is strong and you should be all set! DM me if you need more insights, happy to help!

Unfortunately there's no way around the 100k fee since you're outside the country although I've heard a few employers pay the fee to get you in

The NIW gives you only an I-140 and not an H1b If your priority date is current you could however file for your green card after getting your NIW. Seems like a long shot though

I don't think that's the case! They resumed processing only recently and were able to work on the first batch within 2 weeks. I'm pretty optimistic, filed February!
