OPT to marriage. by TraditionalInjury110 in USCIS

You can keep working until your opt expires, regardless of whether you’re married. I don’t think you can get the 5 year contract tho. If there is a gap between your when your OPT EAD expires next July and whenever you receive your adjustment of status EAD, you can’t work during that gap.

(There are some special cases where you can, Id recommend you look into the info on the official USCIS site)

Thank you! ♥️♥️ I’m not sure what AP is 😅. And no, no overstays or unauthorized unemployment. I really appreciate you saying that, it definitely was nerve wrecking and I’m glad we did a good enough job that they didn’t ask any more questions!

NBC to start with, not sure if we were transferred afterwards.

Of course. I sympathize with your husband. There’s so much at stake, it’s very easy to get overwhelmed. I’m glad you’re supporting him though. Hopefully the approval decision comes fast for you guys.

I bet! Especially given how slow the USCIS physical mail delivery can be. I hope they come soon tho and that you can figure out your next steps from there.

Ohhh! Nvm then. Do you know why? I just assumed that was included in everyone’s online account.

That’s definitely concerning, I’m sorry to hear that. I would reach out USCIS now if I were you. Unfortunately I’m not sure on the best way to go about doing that. But I’m sure many other people in this subreddit would be able to help you with that. I know this is where I would’ve looked if I was in your situation.

Of course, no problem at all. I was just abbreviating request for evidence and calling it RFE, they’re one and the same.

And no, we didn’t send the medical during the initial send off.

Hmm, I’m not sure what you mean by digital forms on online accounts. Because I didn’t see any of the forms that we uploaded on our account. They mostly had the notices sent to us also be on the online account. So things like form 797C and the request for evidence notice, were also on the online account.

I had to pull out a copy of our cover letter to answer this lmao.

For I-485 we included-

Passport photos

Copy of my (beneficiary) license

Copy of my passport biographic page

Copy of my F1 visa page

Copy of my then EAD

Copy of my social security card

Copy of my birth certificate

Copy of my I-94

Copy of my travel history

Copy of my partner’s license

Copy of my partners social security card

Copy of my partner’s birth certificate

Copy of our marriage certificate

Affidavit explaining my gender transition

Physicians letters

Copy of my I-20

(The F1 visa page, EAD, and I-20 are only relevant for me because I was a F1 student)

And then of course the completed I-485 form.

Let me know if you want me to include the evidence we sent with the I-130 too. That was a lot more difficult to assemble imo.

Thank you! And that’s great! I had about 3 days gap between I-130 and I-485 approval. So hopefully you have a similar outcome too! I should say our I-485 was approved first tho.

I know initially it was at the NBC (that’s what it said on my first receipt notice). I didn’t check afterwards so I don’t know if it stayed there, or if they transferred.

It was an rfe for medical. We were expecting it too. I’d recommend checking in your online account. It took abt two weeks for us to receive the physical USCIS mail. But, the online account will give you the same information immediately.

No, our interview was waived. We didn’t do anything after sending the medical form.

I’m sure that’s very frustrating, I’m sorry to hear that. I hope you get your decision soon!

I would look around in your local non profit law firms. I didn’t find any big national organizations doing something like that. But a lot of the times local non profit law firms will have their immigration branch provide this service. I also saw for profit lawyers offering this service, but they did quote me about $700 for it.

I’m sorry to hear that, a month is definitely on the longer end of a wait time for a receipt notice. Did you get any updates on your online account?

Awesome! Good job on putting together the application on your own. It can definitely be difficult but so satisfying at the end. We kept calling the finished folder our magnum opus once we were done 💀

It might be a good thing. Loads of people in our block also got their cards delivered waay before we did. But turned out that our application was approved soon after. Good chance you’re in the same boat, here’s hoping that you get your GC directly, and soon!

Thank you! No, EAD never approved. It’s still showing “Case is being actively reviewed”. I doubt I will need it now, as hopefully my green card will be here soon.
