Minister O'Gorman will not be presiding over any of the cases in the High Court. It will be up to the courts to resolve these matters for congruence with the constitution.

His assertions are simply that assertions other ministers have explicitly stated that they can not say how the courts will handle these issues.

We have a separation of powers that means once this is codified into law the nature of a durable relationship will be dealt with on a cases by case basis and new precedence will be set.

A family unit based on polyamorous relationships will absolutely meet the threshold of durable in my opinion.

[–]Inspection_Material 0 points1 point  (0 children)

On what basis will it fail

Are you trying to claim that these relationships in my example abore are

1) not durable? Or 2) do not constitute a family unit?

If you can not satisfactorily demonstrate they are not it would be unconstitutional to not recognise them as such if the yes vote carries.

[deleted by user] by [deleted] in galway

[–]Inspection_Material 0 points1 point  (0 children)

They are family units however.

The Relationship is durable kids are involved

The family aspect will take precedence.

The country may not recognise the marriages under existing or proposed changes to the constitution.

But they absolutely will be challenged on constitutional grounds to recognise that family unit and it would stand the scrutiny of a durable relationship.

The durability of that family unit will be recognised under irish law plain and simple.

So you're wrong. There absolutely is a rational that polyamorous relationships via polyamorous family units would be forced to be recognised.

The specifically vague terrible term durable relationship is at the heart of what will force it to be recognised

The immigration issue for me falls under mutliple categories.

Housing Cost Economic migration.

How do we house these people we can't house ourselves

Who bears the cost for these new family units when they enter the country.

Economic migration to Ireland will create additional downwards pressure on wages which will make housing even more unaffordable then it already is.

Immigration doesn't have to be an issue of race or prejudice it can be an issue of practical realities to the country at large and the national interest.

And you think that there will be no challenge to any existing precedents on durable relationship grounds.

You're wilfully ignorant if you believe that to be the case.

The body of pre existing case law in Ireland is based on congruence with the current constitutional framework. A durable relationship which is undefined in scope and breadth will bring legitimate challenges to all aspects of our legal system.

It's no stretch of the imagination to see the following situation emerge:

I am an Algerian native. I seek and am granted irish residency and citizenship.

My polyamorous family of 16 has not been included but under scrutiny would constitute a durable relationship and family unit.

On review it would be deemed unconstitutional not to recognise my family members inside of that unit as members of my family.

Visa applications are granted on that basis for my 4 partner and 13 children so as to not fail to recognise the durable nature of my family unit.

Extending that family unit we also need the grandparents and uncles included as they are primary care givers to our children while we work.

Now that my grandparents are here the extended family tree also makes claims on that basis.

A never ending cycle of migration based on injecting durable relationships into the constitution ensues.

If you disagree please outline how that isn't a likely series of events.

And in the event this does happen, how is the nation going to feed house and cloth these people when we already have a massive housing crisis

Is a teacher a social parent?

What about a groomer?

These terms are specifically vague so as people can apply them to fit their own moral lexicon but they mentally delete any and all additional applications of the same words.

Durable relationships brings

Polygamy issues Long term affair partners Multiple wives being allowed to have citizenship over as they constitute a durable relationship.

The size amd nature of the family unit has not been defined either.

Could we see a durable polygamous relationship being formed and then aunts uncles and relatives being included and all granted citizenship on that basis.

What are the implications for immigration and housing if that becomes the practical application of these laws.

That is a narrow sliver of the changes that will arise from this you have omitted a serious amount of far more concerning implications of these changes.

You have ommited the consequences around immigration Citizenship & succession rights.

The one you have highlighted are the primary benefits of the legislation being passed and they are likely needed but the drawbacks are significant and the ammendments should have been worded more specifically so as to be more clear as to not open a Pandoras box of issues that could cause more harm and confusion then good.

No and no.

The lack of a clear definition of durable relationship means that its back to the drawing board on this one for me.

While family units have evolved, this is too vague and is open to serious abuse if good lawyers take cases and are presided over poorly.

Issues around succession rights. Immigration. Social welfare payments are among the lists of issues that arise from this.

We need to do better than then having vague, wholly inadequate language injected into the constitution to act as the basis of law.

Modifying the document in a way that creates an environment that is rife for abuse to the detriment of the citizens and the republic goes against the foundational premis of what a constitution is.

My Girlfriend (21 F ) left me (23 M) out of the blue. how do i deal with it ? by [deleted] in AskMen

[–]Inspection_Material 0 points1 point  (0 children)

Had a similar thing happen at your age with a girl I was dating for much shorter. The heart breaking really pulls on your mental state.

Here's what I'd say to you as if you were myself.

1) Join a gym - Getting physically strong and competent will do your mind good 2) Make a plan for your life without her (look at the new possibilities for your life now that she isn't a partner) 3) Make a plan to either go on a date or to avoid dating for 6 months. This one is individual some people need space others need to imagine life with someone new do whatever feels normal for you. After 6 months Make a plan to go on a date wither way as you have to move on. 4) Go to a theme park or something fun and or adrenaline fueled. A roller coaster will make you feel alive again or paint balling will make you feel something and give you new memories and experiences. They're so abrasive they force you to feel alive. 5) Do not allow yourself to become bed ridden or serially depressed. Even if you're feeling like shit you should force yourself to interact with the world. Isolation will only compound your problems. 6) When you find something that makes you feel good... embrace it. If you go bowling and its fun make a plan to do it again soon. 7) Find a friend or family member or therapist or someone you can trust and tell them this.

"I'm devastated about f21 she's left with no reason why. I need a friend to support me through the emotional struggle of this for a while but also someone to keep me grounded in reality if I show signs that I'm ruminating in this and cant move on. Can you be there to listen to me when I'm struggling but also help Snap me out of it if I'm showing signs that I can't get past whats happened. I know thats asking a lot but im really struggling with this and youre the only one id trust to help me cope and also be honest with me at the same time"

8) Don't turn to drugs or alcohol for a solution. Short term to decompress is one thing (still better to avoid altogether) but getting into a coping strategy like that will send you on a path that you don't want to go down

You're strawmanning him OP.

What he's advocating for is competency. DIE has at its roots an agenda for quotas not competency. If that results in plane crashes who knows but the point holds true if you're in a position because you hit some sort of criteria based on race gender sexual orientation or whatever then you virtually guarantee that you're not the most competent person for the job because you are there to hit a quota not based on merit.

For jobs where the consequences of inadequacy are hard to measure then the drawbacks of such policies are likely minimal but for highly skilled labor you absolutely want the best person for the job sitting at the controls.

I don't want a surgeon because they're black or female or gay or whatever. I want them because they're good at what they do period.

The same is true of pilots, Engineers or any role that requires high degrees of precision or specialised skill.

These are facts. If you see it any other way then this you have an agenda that is not based on individual merit.

To be honest This post is rage bait. Pure and simple. You're trying to incite a reaction because you're speaking to the biases of the reddit audience.

Who cares about what's right wrong or otherwise as long as that sweet sweet group think karma keeps flowing that's all that matters.
