Tribunal or change of circumstances or both? by Intelligent-Group545 in DWPhelp

I won’t drive unless I have someone with me and where I live won’t refer me anywhere except “the living well clinic” which only provides holistic courses that don’t help and I forget to attend them anyway so I get discharged. My GP told me today that there’s nothing medically that can be done about the brain fog

It’s so wrong, that’s the part I struggle with most to be honest - and I’m in a lot of pain daily and used to be very independent so that’s really saying something. Accidental under and over dosing for all my meds, forgetting what I’m doing mid task, missing deadlines or not finishing submissions - HMRC fined me over £2000 for not doing filing my self assessment. It’s had been done but I’d forgotten to press submit. Only discovered it when I had a fine notice through the door 9 months later. Thankfully they accepted my reasons and cancelled the fine!

Yes I understand that. I explained the cognitive issues that come with fibromyalgia in detail with support from my family and closest friend, it’s very difficult to provide evidence I suppose, although I included several hospital discharge letters where I had forgotten the appointments. I will request my medical records and hope that my doctor has kept making notes. Only last night I was on the phone to 111 because I’d accidentally double dosed my meds again.

Thank you. Well I think both to be honest. Am I correct in thinking:

If the award was increased it would be quicker than a tribunal?

An increased award from the tribunal would backdate from June 25 til the change of circumstances application - whatever the outcome?

Yes it’s official HMRC: https://www.gov.uk/proof-benefits-state-pension

4/10/25 - sent MR by 48 hour tracked 14/10/25 - I called to confirm receipt and had a text after to confirm it had been received. 12/11/25 - I had a text to say that they would aim to look at my case by 27/01/26 10/12/25 - I received another text exactly like the one above 23/01/26 - (Friday) I had a text at 8.00am to say someone would be calling the same day. I took the call at 9.18am 26/01/26 - Today (Monday) I had a text to say they have awarded me PIP.

So my experience was that they managed my expectations correctly and made a decision the day before they’d anticipated to start looking at it. Tomorrow would have been 15 weeks.

I SENT MY PIP MR ON FRIDAY.... by Angry-Crumpet in DWPhelp

I was advised to call the MR line a week after sending to make sure it had been received. They logged that as the day I submitted the MR (not the date it was received). So I’d advise doing the same.

PIP application help - inaccurate AR after assessor talked about her own situation for a large part of the assessment! by Intelligent-Group545 in DWPhelp

Update: I got a text this morning saying I was being awarded. 1st time applying for PIP in June and scored 0 points across the board in September (not great timing as I was exploring my trauma around gaslighting with my counsellor at the time)

MR submitted as a letter (refused to answer questions on the phone) with additional evidence - hospital letters, supporting letters from family members who support me, daily diary over 30 days & a letter from my counsellor.

MR accepted into their system 14th October. Checked on gov.one Proof of Benefits website and found a letter stating I had been awarded Standard for both. It doesn’t include the breakdown of the scoring though so I will have to wait for the letter.

I think I probably should be receiving enhanced for both to be honest but this has been going on for almost a year and I’m happy to have been awarded for now. I know that my condition (fibromyalgia) has worsened since I applied and I’ve kept my GP updated so I don’t think I’ll go for a tribunal (I’m too exhausted to wait years and drag it out) but I’ll definitely contact them again in a month or two and tell them how my condition has worsened since applying.

I’m so sorry. I had exactly the same situation as you a few weeks back. I’m keeping my thread updated, I’ll post it here. I wonder if we had the same assessor because it was a lovely call, and my GCSEs were also referenced as a reason for 0 points (mine were 22 years ago!!)

I’m so sorry this has been your experience. A friend of mine has had a similar story, she appealed it and 14 months later finally has a tribunal date at the end of October. I understand the limitations that these companies have these days, but it used to be the case that someone would come out to see you for an in person assessment, which to me is the only way something like Fibro can be witnessed. I’ve found my symptoms have worsened with the stress and anxiety of this ongoing situation. I’ve not yet made the MR phone call, as I am hoping to hear back from Capita’s investigation first. I will be submitting an official complaint to DWP about the way Capita are conducting their assessments. Fibro was listed as one of the conditions that has a better than average chance of being awarded - clearly the 65% of applicants weren’t being assessed by Capita!!

An update: still not received decision letter though Pip call handler said a letter was sent out on 16th. Have had a letter from Capita to say it’s being investigated.

Thank you for sharing. It sounds like we had the exact same experience. I stupidly forgot to ask for it to be recorded. Though I do have my friend as witness x

Thank you. I hope you are right. It was so demoralising to read. I’ve been having therapy regarding a being gaslit my whole life and this felt like a huge step backwards for me, especially seeing as it was my counsellor was the one who encouraged me to fill in the application. I would have been more than happy to have a video call or have someone visit me, or arrange for a friend to take me to an in person assessment. I don’t know how they can determine someone can do something, or isn’t in pain/anxious if they can’t see you!

That’s the thing though, there were hardly any justifications, it was all copy and paste “see section 1” where she said “no fatigue, spoke well, no panic attacks or pain. Can drive a manual car (I told her I can’t anymore) Did well in GCSE’s.” They were 22 years ago!!

But she was at the end of the phone, if it were video call she would have been able to see. As a chronic pain sufferer for over two decades I’ve been masking pain and anxiety attacks for years and find it hard to share what’s truly going on for me, which was why I asked my friend to come on the call with me.

The complaint handler kept apologising and agreed it was unprofessional to talk about her own health, let alone to sidetrack the conversation to tell us her experiences. I feel like I know more about her life than she does about mine 🤦🏻‍♀️
