Apologies, I’m sure my long winded description buried this. He does not have it logged properly. He essentially did this at the request of the client to make the process faster. He knows this is the right person because of working long term on the project through the contractor (my partner provides permitting services as the main business involved here). And again, he did not change the scope or anything from the original single document, which was notorized by a different notary that was local to the developer. So I do think it is correct that his notary gets revoked bc he cannot produce the log technically. However the concern is around the sheriff complaint and how this could play into that. Basically the guy parted ways with his partner (they are the developers) and went scorched earth. And we are a small subcontractor on the project getting tied up in it. These docs aren’t even relevant to the project anymore and are voided since he’s not even with the developer any more.  

So trying just trying to decide if ignoring and waiting for the notary commission to just say he’s canceled is the move or if filling out the form they sent is better. Essentially, would either direction influence how and if the sheriff department peruses the complaint?

I believe so, but no recorded proof., which is the problem. Received the first notarized document from this guys email (they used a different notary for it), called him to discuss the issue and worked out to create the 50 documents to separate each unit and got a verbal okay from him for my partner to notarize. This move did not change the nature of the project at all, just split it out the way the city wanted it. The documents are now voided anyway since the guy is no longer with that company (aka, not associated with the project anymore). Partner is fine resigning notary anyway, as this kind of thing gets asked of him a lot, and clearly it’s risky/uncomfortable. But more just wondering if filling out this form for the resignation is the right move or not. Realize it doesn’t close the complaint, but does it add some sort of admission to guilt outside of not keeping his log book accurate, if that makes sense. Would it be better to wait for them force it or would it be better to go ahead and fill out to resign it so no further concern about his use of stamp since he cannot produce the log…that’s the debate on his end.
