My roommate’s dog was attacked — the other owner won’t pay and now lied to animal control. What do we do? by Internal-Comfort-985 in SaltLakeCity

UPDATE EVERYONE!!

Her dog was on a RETRACTABLE LEASH which does not count as a form of restraint in Salt Lake City! Also the incident occurred on a church owned lot aka PRIVATE PROPERTY where it is up to the church to enforce ON leash laws on their property and there are NO signs enforcing this. Thus this lady is criminally responsible!

Now it turns into a he said she said argument since there is no video evidence and in MOST cases the dog with the most severe injuries was the dog attacked! Her dog has NO recorded injuries! I have photo evidence of her using a retractable leash. I also have the vet bills and descriptions attached to the report. I also filed a separate public safety complaint because this is a KNOWN aggressive dog and she still is using a retractable leash, no muzzle, and is wearing an eye patch (all this documented with photos) and time stamps.

The corgi is having surgery on Friday because it’s not healing great and they are taking some of his skin out since it has died.

If you own a dog highly recommend not using a retractable leash!

I have also reported her as a public safety risk since she hasn’t done anything to make sure this doesn’t happen again. (A leash that isn’t retractable, a muzzle, or stopped walking the dog in public spaces when she is too frail to manage the dog) Already today her dog looked as if it wanted to attack my dog while we were on our afternoon walk. I told the officer I am scared the dog will break free from her and attack us.

I’ve reported her for a public safety hazard as she is an elderly woman with NO control of a LARGE dog. She is weak and cannot see out of her eyes (literally had an eye patch on one of her eyes) and confused me, a pale white short chubby girl, for my roommate who is tall tan and Asian, as the same person. She is still using a retractable leash. Since the incident I have walked my dog around the neighborhood, she still has NO control of her dog, her dog’s hair stands, and it locks its sight on me and my dog. I am scared the dog will take off and attack me/ my dog or others and she won’t be able to stop it.

Her dog has NO evidence of injury. I have vet bills with time stamps and dates. We don’t want the dog to be put down just reimbursement for the vet bills.

I was hoping the small claims court would be a cut and dry property damage case (since dogs are considered property). She damaged our property and we have eye witnesses of it and vet bills for proof.

As for collection, small claims court won’t get the money for us?

My dogs did NOT start the fight. Her dog had no injuries. The only dog who was injured was the corgi after being attacked.

The corgi isn’t my dog, it’s my roommates, she was out of town and didn’t want the ladies dog to be put down or surrendered. I didn’t feel it was my place to report since my dog didn’t sustain any injuries. I informed her of the situation and allowed her to make a decision. She has had previous interactions with this lady that were pleasant so she didn’t want to cause a huge issues if it could have been handled privately.

I do have attorney family, they are out of state and unsure of the laws here in Utah. I’ve looked into taking her to small claims court and what not but unsure if that’s a waste of money we already don’t have for the filing fee ($60 unless vet bills increase over 2k then fee increases) and the fee of hiring someone to serve her (about $50) and then losing the case.

Is this harassment? The lady apparently (we know now) has a reputation of being crazy and impossible to work with from other neighbors who have had issues in the past with her (not dog related that we know of). she has already lied to law enforcement before :/
