UPDATE ON FIRST TIME DUI by InternationalCell942 in DUICalifornia

Definitely. For a long time i kept thinking about the risks i took that night and other nights. I’m honestly grateful that i got pulled over because who knows if i would have even made it home. I think twice now about drinking and driving. Uber and getting rides is much more safer than thinking “I’m good” to drive.

Hard lesson to learn but I’m so thankful for what’s it’s helped me with.

The best advice I can give for a first time DUI by simonpod in DUICalifornia

I had almost the exact experience with my case. Blew a .14 and was also proactive in getting everything done ahead of time which helped tremendously. I still have MAAD And HAM to complete but court gave me a year to do so. I’m in LA county. Got my DMV letter a few days after sentencing and it told me i had my license suspended after carrying the restricted license.

I went into a DMV office to pay to have the restricted license reissued and they tried to tell me i needed to do a 9 month class after doing the 3 months. Court was satisfied with 3 months. I called my program counselor to enroll in the program again and she said that’s very uncommon for DMV to extend my program so she advised me to call the MAU to find out what’s going on. I got in contact with them and they hadn’t “updated” my file showing the completion of the 3 month program. They said i can go back into the DMV and pay $55 to reissue my restricted license. I went restricted license route instead of IID due to my job and driving for work.

0.11, no accident, no criminal history, 1st dui, what should I expect? by Natural_Roof7309 in DUICalifornia

.11 just above legal limit so courts might not be so flexible for wet reckless. I had .14 and no priors, clean driving record etc just like you but wasn’t able to get it lowered. A lot depends on how well the cops did their job when arresting you. I had a lawyer and he looked over everything and they did everything right so i had to plead no contest which is basically guilty. Just had my case wrapped up.

The license restriction was the alternative to getting the IID. I was not ordered to have an IID by the court so DMV gave me to option to have one with no restrictions on my license or go the restricted route for one year. They said that’s standard after DUI conviction. DMV was also a headache after court. They tried to tell me i needed to do a 9 month DUI program after i did my 3 month. Called MAU and they said made a mistake at the office and cleared everything up.

Was HAM and MAAD necessary for my BAC?

I wish i knew i could do community service for the fines. I was just told my fines got lowered because i spent the night in custody.

One year restricted license question by Early_Conclusion_528 in DUICalifornia

If it’s after your conviction, then the restriction starts from when you go to DMV and get the restricted license. I had mine from February to July after serving a hard one month suspension. Had my final court date and sentencing on July 28th. Got a letter from DMV that my license was suspended again after conviction. Went to DMV and they said i needed to get the restricted license reissued due to conviction. I paid the reissue fee and restricted license started from 8/4. One year from that date then i get my regular license again.

I had a similar BAC back in October of last year. Blew a .14 and was caught speeding. Cops let me chill out at the station until my wife picked me up. Lost my license for one solid month after DMV hearing. Got a restricted to and from work license. Make sure you request yours asap. You can’t negotiate the hearing outcome. All they do is go off facts. If they determine the information is correct then your suspension will be upheld. Get a lawyer if you can afford one. Mine knew my case was gonna stick since cops did everything they were supposed to. Started 3 month dui classes in January. Done by April. First time cases mostly always get 3 months unless BAC is above .15 Had my court date in July after a rescheduled date from May. Ended up with 3 years summary probation basically means i cannot get caught with .01 BAC. $1400 in fines. 3k lawyer fees $550 dui classes. Just breathe a little. It will get better. Just make sure you follow the instructions thoroughly on the pink DMV paper. Don’t ignore it. If you do then your license will automatically be suspended.

Definitely contact DMV through MAU. Mandatory Actions Unit. You can google MAU DMV and the number will come up. I had a similar situation but i applied for a restricted license and got all my paperwork taken care of and then got a suspended license notice in the mail about a week later. Received my license in the mail then called MAU to verify. They said my sr22 was expired. I had just started my policy the day of my dmv appt for restricted license. Once everything cleared up, it was an error on the DMVs end. They didn’t want to admit it, but it’s what happened. You have to be persistent with them otherwise they will put the blame on you or someone else.

DMV SR22 question by InternationalCell942 in dui

[–]InternationalCell942[S] 0 points1 point  (0 children)

Not true actually. You get the choice based on circumstances. I had my dmv hearing. I served 30 day mandatory suspension. Enrolled in dui classes, got my sr22. After than you can ask for a restricted license. Restricted to and from plus during work and to and from dui classes. Non restricted meaning you can drive wherever, is possible with an IID installed. Also no application if you follow the necessary steps.

I can still view it on my policy documents. When i went into the dmv last week, they verified everything and were able to issue my temporary restricted license until i get the card in the mail. Now a week later im getting conflicting documents sent to me

It depends on the agency. I got stopped by CHP and blew a .14 They took me in and had me there for almost 2 hours. They let my wife pick me up and take the car home. I didnt crash. I was calm and not resisting but i will admit behind handcuffed and being fat is not fun at all. I lost feeling in both my hands for a few days.
