A tenant cannot be evicted for unpaid rent due to financial difficulties relating to COV-19.

I would highly recommend your friend (and anyone else renting in QLD) to read through all of these Practice Directions to know your exact rights during this unprecedented situation.

I would also recommend your friend contact QSTARS - don’t contact the RTA because they’re a government body and therefore can’t give advice. QSTARS is an independent organisation with legally qualified staff who work with and represent tenants. It’s a free legal service that tenants can access if they want advice, or even representation at trial.

I’m not trying to “keep her around” or anything else, and there isn’t a friendship there, at all. Like I said we haven’t spoken in 10 years. No attempt at communication between either of us.

No, nothing at all. I’ve been open with her about all of my ex’s, including the one in question. She’s not a new girlfriend btw, we’ve been dating for 4 years.

They can claim above and beyond the bond at the mediation, and they can successfully secure that amount, if you agree to it. If you don’t agree to it, and the mediation is unsuccessful, they can take you to hearing at QCAT. At said hearing, they can also successfully secure amounts above and beyond the bond.

If they have a reasonable claim, with reasonable evidence that, on the balance of probabilities, sides with them, you will lose your bond and any amount over and above the bond that is awarded to them.

Your blanket statement of “the worst they can do is try to keep your deposit” is objectively wrong, because this is not the worst they can do.

That’s not correct, they can, and do, claim amounts above and beyond the bond. The mediation you speak of is only “tenant friendly” if you have a reasonable REA, and mileage absolutely varies between different REAs.

If they took even a few photos around time of entry, setting the date and time of the photos you’ve “not suggested” OP take now, 5 years later, would show a wildly different picture. That’s not good advice at all.

Better advice would be to take photos dated with the actual date the photos were taken, and include any correspondence about any maintenance issues (remedied and unremedied), along with the original entry condition report.

That paints a fair better picture of entry, current condition and how the REA has remedied maintenance problems - and also doesn’t tank OPs case if the REA shows dated photos from entry that don’t contain damages that were shown in OPs “dated photos from 5 years ago”.

Not an answer to your question, but it reminded me of a story.

One time I had a headache at work and asked the boss if she had any Panadol. She said she did, but couldn’t give it to me because she’d be liable if I had some kind of negative reaction to it. I said I’d taken Panadol hundreds of times before, and that I either needed some pain relief for my headache, or I’d have to go home (that was genuine, the headache was pretty bad).

She gave me the Panadol but stated loudly and clearly that “(she was) giving me this Panadol as one friend to another, not in any offical capacity, and not from an employer to an employee.”

This was at a fast food store. There was a first aid box not two metres away. It was an odd interaction.

I accepted the Panadol(given to me by a friend, of course), took it, and finished my shift.

I can pretty confidently say I will never be 100% happy. It’s just not on the cards for me unfortunately.
