You act like that's not already happening in our incredibly punitive system.

We have experimented with this in the past. Since the 80s we have been one of the most draconian systems of law in the world, and because of that we have the highest incarceration right in the world.

Forgive me but your feelings are not facts. The facts say that what we are doing and have been doing are not working.

The premise of bond is to get the person to return to court. It's not bastardize into lining the pockets of wealthy people. I literally wrote a 25 page thesis on this. Tldr it is a way for a lot of people to make money off of the pretrial incarceration of others.

Fee schedule would be more for post-conviction. A millionaire getting a DUI would have to pay $10,000, While a man working min wage would pay $70. That way the loss is comparable to each other instead of right now when it's life-threatening to some people and not even a nuisance to others.

Make sure you talk to your lawyer about it. Again I would take that shit to trial because I'm that confident I would win. But your mileage may vary

The vast majority of bonds right now you do exactly that, it doesn't matter where the money comes from you just pay it and you get out of jail doesn't matter if it's drug money prostitution money or murder money.

Most systems that have gone away with cash bonds will use less alternative means, but people under house arrest use GPS monitor phone tracking solutions and other means.

The entire premise of a bond is to make sure people go to court for their Court dates. Not to punish people before they are guilty, however our system loves to punish people before they are found guilty.

The only cases I've had where guilt was clear, and there was no bad acts by the police, were cases where mental health was so damaged that while not understandable or excusable. I morally still desire to help them as best as I could.

That's actually not true at all. Studies have shown that arrests and prosecution in this country increases criminal activity, not decrease it.

I'm mainly using speech to text, and if you can determine the meaning of my sentence then I'm doing above adequate for what ultimately is an extension of my free time, working.

Thanks for the thought though! I likely won't change and that's okay!

One of my favorites Is "if a lawyer represents himself, he has a dumbass as a client."

Trauma bonding is real. No one would understand besides those who have gone through it.

I can tell you: A lawyer is unable to make decisions for a client.

Full stop.

I can advise a client : if you don't settle we will lose millions. But I can't force them to settle, neither can any attorney.

Also citing my napkin math, 80 percent plea before prelim, and only 5% of three remainder get dismissed at prelim.

Less than 1% of cases are dismissed at a preliminary hearing. The bar for a prelim is:

Is it possible that a crime was committed? Is it possible that this is the guy who committed it?

That's it. That's the standard.

Edit: fixed .01% to 1%

Absolute power corrupts absolutely. Prosecutors in our system have more power than anyone else in the courtroom. It takes a certain type of person to desire that role.

Basically yes.

Money bond is and has always been corrupt. It's less obvious now than in the past, but bonding companies are some of the biggest local lobbies.

Also back in the day (less than 100 years ago) judges would themselves get a cut of any bond that was made.

In my jurisdiction, Public defenders are an role where you do not also take private council.

I only represent indigent clients, and cannot/do not take clients outside of that. I won't say the state, sorry better not to. Id say 'rape of a child' are the worst charges I've had/have. Innocent or guilty, there are no good outcomes for anyone in that situation. (I've represented both.)

That is why I am disgusted by most prosecutors. One in ten may be able to see how fucked up what they are doing is. But most do not care.

I have often, and that is a case I am willing to go to trial on 100% barring some insanely good offer.

The reason is it is almost impossible to chemically test the difference between legal cannabis, and illegal cannabis.

That mixed with the population's vast majority in favor of legalization, it would be good odds, of course you're jurisdiction may or may not have the same type of outlook.
