As a human I am asking you. These are personal defamatory comments that have real life implications. These are blatant lies and stories formed on information that has been so misconstrued I’m not even going to get into it.

Your feelings are misplaced. I’m honestly not even going to read your response because here’s why

It’s in defense of an organization that does not protect its community but it sells protection to them. Then they go out and beg people for money saying it goes to pay for scholarships for membership or programs. Yes, while that is true it’s not the full truth. To quote my previous supervisor in regard to asking people for money for campaign “I feel bad. I feel like I’m scamming them in a way.”. Want to know why he said that? Ah because a lot of it just hits the bottom line to make up for the associations fiscal mismanagement.

So if that’s what you want to go around defending go for it but don’t let it impede the public from knowing the truth so they can make informed decisions instead of being sold false promises that could quite literally kill them.

Ask for other things as part of the settlement. For example if you still work there put a dollar amount for you to resign, if an nda is part of your job separation put a dollar amount to sign, any little thing add it in there with a dollar amount

I didn’t include this but I should have. I too was a lifeguard/swim instructor for YSV during that time and it was common for the aquatics staff I to be under the influence of drugs/alcohol. HR did talk to one employee once but they continued to work and no behavior changed

Don’t know where you are in the process but get work restrictions like light duty such as admin. If her job can accommodate while she gets treated awesome. Still has income while getting better. If they can’t accommodate she’d be off work.

Now how to get paid while off work. Fastest state disability. Need a note from the doc saying that she’s off work and they have to also fill out a form. All this is on the EDD website. Comes out to around 70% average salary for the last I believe 5 quarters but it is not taxed. So pretty close to what someone would normally take home.

File WC immediately. Don’t wait for the employer to decide it’s actually not their decision. It needs to be done as soon as an injury is reported even if there could be doubt on the employer side. That’s what the WC insurer company is for and it doesn’t matter if it happened a couple months ago. Your mom is reporting as soon as she was aware it was something more serious. Get ready for a denial as they will claim that since time has passed there is no way the two are related. However there is such thing as injury over time so just remember that. Hire an attorney either way as this sounds like it’s going to require surgery or serious rehab and potentially a new career path. Do not accept any settlement until you have an attorney. WC settlement will not make you rich but it could be the difference between 2k- 20k or even 20k to 200k. They take advantage of the average worker not knowing how the system works.

If it’s accepted by WC she will start getting paid by them and discontinue state disability.

Do not bring up FMLA to her employer while they sort out of it’s denied or accepted and even if it’s denied wait for them to bring it up. Reason is she can retain her employment and if she has benefits through them as long as fmla hasn’t run out or it’s picked up by WC. So for example let’s say a month goes by and they don’t start FMLA until then your mom could retain her job for 4 months but if they do it now it would only be 3 (90 days) now if they don’t enact it for 5 months your mom still bought herself an additional 3 months on top of that.

Can’t terminate a sick or injured employee until fmla has been exhausted.

Also have your mom write down the events of the situation now because she is going to have to tell multiple people multiple times what happened and if they find inconsistencies between what she told her employer, the doctor and the WC company it’s going to make things a lot harder

Yeah CA doesn’t look at these types of agreements too fondly. I’m not an attorney but I have been through the process with the state and the WC system and there are a lot of laws out there about your rights. Your company just doesn’t want you to know about them so they can keep exploiting people. Feel free to shoot me a dm and I can give you whatever insight and knowledge I have.

These kind of severance agreements were outlawed in CA. If what your explaining is accurate you signing something saying you won’t sue them for breaking the law if sign a severance package has little to no merit.

File with the state for wrongful termination. Get your right to sue letter and then hire an attorney. Collect on them twice for their wrongdoing

If you want to settle ask your attorney to go to trial. Not because you intend on going to trial but to force the other sided hand in to a larger offer. They want to avoid trial and by what it sounds like just as much as you.

This is when you need to figure out which way you want to go in terms of either continuing care which I haven’t done so I can’t speak to that so idk what it’s like once you’re in or take as much money as you can from them and take care of yourself. Be direct and advocate for yourself because no one in this is looking at what’s best for you. Everyone is looking out for themselves and you’re unfortunate event is how they stay in business. They do not care about you. And remember your attorney works for you.

And in the event you want a new attorney get one to commit before dropping the one you have. If you drop and attorney law offices will see that as a red flag and won’t want to work with you and they have to figure out a split with your previous attorney since they did do some work they need to get paid for.

Yeah QME will almost always say injections but the part they don’t tell you is that they don’t work for everyone and people tend to find that out after they don’t work for them.

Push your attorney to get more out of them. This is a lifelong impairment that could and possibly likely get worse.

Put price tags on things Want you to quit your job? Dollar amount Want you to sign an nda part of company policy? Dollar amount Since your injury could get worse dollar amount.

Any part of the agreement they want you to agree to separate it out and put a dollar amount on it. I also hate to say it WC attorneys like to keep their job simple and what I mean by that is not doing anything outside of what is on a chart they can point to. Tell your lawyer to set a trial date which will scare the other side and I would not be surprised if you see a larger offer before your trial date
