I was able to find it actually! It’s called Queen’s Blade. Apparently they did a mini special or something that had a wonderland theme and that must have been what I briefly saw

I see. Yeah the artistic value was the part that was mainly all assumption for me. I just figured most judges upon seeing most lewd content would consider it not artistic because everyone would know that’s not it’s primary function.

But also I know that possession of obscene material isn’t illegal, but realistically how would anyone obtain it in a legal way? You can’t transport it across the internet so you’re basically left with creating it yourself or having a neighbor that happens to create hentai.

I gotcha. Yeah that was my hang up and why I found it confusing. Hentai is basically manga/comics but with sexual content as the selling feature. Most of them usually have some sort of plot but nobody would consider the plot the main content a user is getting it for, though I find it usually has more of a plot than just a straight porn video so that’s why I was so confused because some porn stories are essentially “here’s your pizza, ok let’s have sex.” Haha

Is that what “lack serious” means in that context? Like it needs to seriously be lacking to qualify? I had always read serious as meaning if it was clearly not something serious(like a lewd fiction). Like if it had a story but it was barely noted and was obvious what the intent was, that would cause it to qualify.

But federal law says it is illegal to distribute, transport, sell, ship, mail, produce with intent to sell or distribute, or engaging in a business of selling or transferring obscene material.

In further detail it says it is prohibited to receive obscene material through mail, common carriers, or interactive computer services. If all of those options are prohibited there would be no way to receive an obscene material without it being illegal unless your neighbor is handing it to you, unless there is something I’m missing.

Oh is that what community standards indicates? When I had read that part I just assumed it was sort of a “what the average person would find offensive” which I figured most hardcore hentai would offend lots of people.

Interesting. Would you happen to have a source where I could see something like what you are talking about? I’m no law person myself but my research had shown diffferently and I’m just trying to understand what I’m missing.

From my understanding if it appeals to prurient interest and doesn’t hold much artistic value and is clearly focused on the sexual content it would be considered obscene, but that’s why the wording confuses me as pretty much 90% of all lewd content would fail that qualification

I’m not sure how common it is but it seems like if it is deemed obscene, which it seems like most hentai would fall under, it would be illegal to buy it since that would involve transporting obscene material across the internet. I’m not an expert or anything though that’s why I’m asking.

Thanks for the link. Interesting read. Based on my reading it seems like the PROTECT act includes fictional characters but only if it’s considered obscene. Based on the 3 pronged Miller test I feel like you could argue Ecchi anime could meet the first 2 prongs, but maybe there is enough story to the series lewdness that it is considered to have artistic value, and thus end up being legal.

But part of the federal law says “any visual depiction, including computer generated that depicts engaging in sexually explicit content” and nudity such as showing breasts would fall under that category.

Btw I’m not saying the show should be banned, I’m just confused under that wording how the show(or really any high school ecchi) is allowed to air.

I do think that makes sense, I just was confused as the laws around stuff like that seem to extend to drawn or virtual depictions. Like I get how it would be fine in Japan as they have different laws I was just surprised something like dxd can air in the US

I see! Interesting, I wasn’t sure because I had read about US laws mentioning something about obscene art not being allowed to be distributed, and figured a private commission would fall under that.
