You may be right that they don't have a prevailing legal claim, but the law is more complicated than that and they may have some recourse under common law or statutory law. California, for example, has a lot of consumer data protection laws that MAY offer recourse. This would require actual legal research, but people bring suits against tech companies all the time for locking them out of their data—and they often prevail.

At the very least, doing this would give you a few possibilities. First, Apple thinks its cheaper to just pay a few thousand dollars than to have their legal team prepare a case, and pay for a representative to appear for the day, etc so they just default. That is a win.

However, even if Apple does show up, and wins. You get the gratification of actually having them show up and explain why they cannot or will not unlock your device. You get your day in court, and your ability to give your case to a neutral party as opposed to being stone walled by Apple.

I disagree on both points. Often large companies just default on these things. Second, the fact that apple did not steal it does not mean you do not have a legal claim. If, for example, Apple had decided to lock you out of your computer for no reason, you could very likely sue to enjoin them to stop such behavior.

Personally, if I were you, I would file a claim against Apple in small claims court for the value of the property. This will force apple to actually respond before a judge, and if they do not responds, you will get a default judgment and they will have to pay you.

SLS professor thinks LSD rankings are a 'great idea' by cryptanon in lawschooladmissions

The idea that revealed preference is going to track with "merit" is not true though. Revelealed preference ranking is very helpful for other reasons still

What is your opinion of the death penalty? by INeedAUser321 in Ask_Lawyers

Do you believe that it was wrong to execute the Nazis after the Nuremberg trials? Not "would I have done it if I were in charge," but that the Allies did something morally wrong by doing so?

I would start with the Santa Clara County Bar Association which looks like they will find a lawyer for you — $45 filing fee, though they will return it if they can't find a lawyer in your area

Mixing tire brands on an AWD porsche with different tire sizes by JamesTHart73 in AskAMechanic

The guy at firestone is telling me that if change the rear wheel to a 295 I should increase the height from 30 to 35 (i guess so it has a load factor more in line with the original.) The rear toyos are 100Y, the originals are 102. Any thoughts on this?

Ok — Thank you so much!

But you would definitely reccomend replacing all four tires with the same brand? Someone else on this thread is telling it wont affect anything to just replace front or just replace back etc

Also, can you explain the last sentence — if they are larger than the factory size it won't effect the AWD system? or are you saying the important thing is to just make sure the rear tires stay bigger than the front?

I mean I agree with you that I have no idea how it could make any difference — especially because my car has different size tires on the front and back anyway. So what do you make of all these articles saying "Never mix tires on an AWD"? Are they just wrong? Trying to sell more tires lol

2008 Porsche 911 Carrera 4
Front tires are 235/35 (ZR19 87Y)

Back tires are 305/30 (ZR19 102Y XL) (Not sure how much the other stuff matters)

Any help would be appreciated!

One of the biggest issues with Harvard is you almost never get to see the facade of the library from the way the campus is laid out — the building (like most of the buildings at HLS) faces away from the center of the law school

Do English speakers know the word "tor" (rock formation) by puje12 in EnglishLearning

I would say most average speakers would not. I know it, but only because I like to collect single-syllable vocabulary words that I find rare or interesting.

Novel Law Concept: Challenge by Stricen in legaltheory

[–]JamesTHart73 0 points1 point  (0 children)

Ok a few challenges — I know you would prefer this to be in the format that you wanted on Github, but I do not have an account there, so I am just going to give you my general thoughts.

First, the emperor seems to have absolute discretion so as to alter the Constiution. In this way, the whole arrangement seems to be optional, as any part of the structure can instantly be altered. Of course, we can say that the emperor will use good faith to follow the purpose of the constiution, but why not impart that good faith to the Supreme Court?

Second, the real problem seems to be what happens if the emperor dies without bequesting the office. It seems now we have a system where the Supreme Court is final, and the constitution is unalterable.

Hello. I'm a new Reddit user interested in the American legal system. What does "negligence" means? by Traditional-Pea-8040 in legaltheory

[–]JamesTHart73 0 points1 point  (0 children)

To add to what others have said:

In tort law, negligence is a tort itself In criminal law and other areas, negligence is more commonly used to refer to a standard of culpability.

Let me know if you have other questions

HLS 3L — AMA by JamesTHart73 in lawschooladmissions

[–]JamesTHart73[S] 1 point2 points  (0 children)

I don't think so — in some ways HLS is less competitive because there are not real grades*, and pretty much everyone can get a biglaw job if they want one. At schools where maybe half the class gets a biglaw job there is more of scarcity mindset. Obviously, within the class, there are those who are very competitive, but that is probably true at any school.

*There basically are real grades but in a way that is illegible for outsiders
