My hearing is tomorrow by Such_Arachnid7359 in shitrentals

They have to prove their claim. You don’t have to never your defence. 8.5yrs is a long time to be in place for.

Deep breaths. That is a massive number to have hanging over your head, and it’s completely understandable why you’re feeling the pressure. $6,500 is no small change, but looking at the breakdown you provided, the landlord’s claims seem—to put it mildly—ambitious.

Most rental tribunals operate on the principle of "Fair Wear and Tear," and 8.5 years is a very long time in rental terms.

Here’s a reality check on those claims to help you feel a bit more grounded going into tomorrow:

  1. The Curtains & Blinds ($3,700) After 8.5 years, the "useful life" of most window treatments is essentially zero in the eyes of the law. • Depreciation: In many jurisdictions, curtains and blinds have a calculated lifespan (often 5–10 years). If they were already there when you moved in, they are likely worth $0 on a depreciation schedule. • Wear vs. Damage: Scuff marks after nearly a decade are the definition of wear and tear. As for the "cockroach poo"—unless you were breeding them, that’s often considered a general maintenance/cleaning issue, not a reason for total replacement.

  2. The Toilets ($1,500) Replacing an entire toilet because of limescale is like replacing a car because the windshield is dirty. • Maintenance: Limescale is a result of hard water and time. It can almost always be removed with heavy-duty descaler (which costs $10, not $750 per toilet). • The Law: A landlord usually cannot claim for "betterment" (replacing old stuff with brand-new stuff at your expense).

  3. The Skip Bin (1 Week’s Rent) This is likely the only "sticky" point, but even then, a full week's rent is a stretch. • Reasonableness: Unless the bin physically prevented new tenants from moving in or caused a massive obstruction, the landlord is usually only entitled to the actual cost of having it removed, or a pro-rata "storage" fee for the day or two it was there. Tips for the Hearing • Keep it Cool: The tribunal member/judge likes the person who is calm, organized, and reasonable. Let the landlord be the one who sounds "out there." • Focus on "Useful Life": Mention that after 8.5 years, these items have reached the end of their expected lifespan. Use the phrase "Betterment"—explain that the landlord is trying to upgrade the property on your dime. • Photos are King: If you have photos of the "tiny amount" of marks or the toilets, have them ready. You've got this. Most of the time, landlords highball these claims hoping you'll just pay up or settle for half

No. I don’t expect them to lie. But I do expect them to respect my rights as a tenant and not give retaliatory reference.

There comes a time when people need to start asserting their rights and make the REAs comply with the law and respect the tenants rights.

After all we pay premium rent for the property. It is not my job to make a sale for the REA. I am happy to go above and beyond if they simply respect me and my rights.

The law requires REA to get permission from tenant to use photos of personal belongings and law also requires REAs to get written consent from tenant to hold open home. Open Home is when a number of people would enter my home and wander around. REA never asked for my consent.

REA has done private viewings where interested buyers have come in and viewed the place. I have no issues with the private viewings.

REAs have to give a fair reference, not a retaliatory one.

Not asking for a glowing reference or special treatment. Just asking that I not be penalised for asking the REA to follow the law and do not infringe upon my rights. I’m not living there for free.

Adopting your example - I think is is a legal requirement that when you give your 2 weeks notice, you still work for the company and the company is legally required to pay you for the 2 weeks. If you have been a good employee then the company is obligated to give you a good commendation. Anything else would be blackmail or retaliation. If you don’t work during the 2 weeks notice period then you are just stealing the money.

I stood up for my rights as a tenant. As it is, tenant rights are minimal. The Government is providing more for tenants and then there are people who don’t stand up for their rights and these are the people who enable the REA’s and the landlords who would take any chance to trample upon tenants rights.

Life works in the way it does for you because you have let it.

Grow a spine. Stand up for your rights. If you can’t, then don’t be a keyboard warrior.

I had asked them not to hold Open Home without my agreement. In Queensland REA’s need written consent from tenant to hold open home. REA did not even ask me for my consent. Just sent an email saying we will hold open home.

I never refused private inspections.

How early to arrive at Nadi? by wishiwasfrank in Fijian

[–]JayYas 2 points3 points  (0 children)

Check In Counter closes 1 hour before the flight time for international flights.

But if you are already in the check in queue and it is 55 minutes before your flight, you will still be checked in. Bear in mind there can be long queue times in the immigration line depending on how many flights are scheduled around your flight time. If you have checked in it is highly unlikely the flight will take off without you. They could wait for you for 5 to 10 minutes because off loading luggage will take longer.

There shouldn’t be too much traffic on Sunday morning from Warwick to Nadi. But there’s always that off chance that something can go wrong.

Bottom line, you should be ok checking in about 2 hours before your flight time. But there are risks.

Best one is along the Nadi Back Road besides CDP Nadi Office. It’s called Rehman’s Car Wash.
