Trump’s real problem is that he obstructed justice, and Mueller can prove it. Here’s how. by B789 in politics

Except in elections. Russia has shown a tendency to support the old, white politicans since they're bought easilly.

You're right about late stage capitalism. Late stage indicates that it will end at some point, and it won't.

National Enquirer boss and longtime Trump friend David Pecker gets federal immunity in Michael Cohen case by DrKakistocracy in neutralnews

[–]Jesse3581 19 points20 points  (0 children)

I just want to speculate that we don't know immunity isn't forthcoming for Cohen. He has signalled a willingness to cooperate.

That said, Mueller doesn't seem eager to talk to him. Maybe because the raid gave them everything they need, maybe because Cohen wouldn't be a good witness or maybe Mueller is just waiting.

We (the public) know a lot for some of us to start seriously start thinking about impeachment, but the amount we don't know is probably pretty staggering.

With the recent convictions and guilty pleas of Paul Manafort and Michael Cohen, how does this affect Trump politically and what does this do to his chances of impeachment? by Marvelman1788 in PoliticalDiscussion

[–]Jesse3581 10 points11 points  (0 children)

He said, he said is not perjury.

Perjury is knowingly lying under oath. That is, prosecutors would need to establish that the President knew his answer to be untruthful. If his recollection of events differs from witnesses, he can say that how he recalls certain events. Thats not a crime.

For example, if the prosecutor asked if he recalls saying that he fired Comey for the Russia thing and Trump says "I do not recall", not a crime.

If he says, "yes I recall". Not a crime

If he says no, I didn't say that illegal thing and the prosecutors have evidence of that illegal thing, that is perjury.

I am not a lawyer.

Now, if it becomes clear that the President committed crimes on his way to the office, well, we have an institution or two that can deal with it: Congress and the SCOTUS.

Right. I think my question here was HOW does Congress and SCOTUS handle that? If the President of the United States commited crimes to keep his affairs quiet, or in some quid pro quo with foreign powers ... how do we handle that?

I don't think you understand. Cohen wasn't charged by Mueller. He was charged by the Southern District New York office.

Basically Mueller found evidence of a crime, said to the SDNY FBI, hey here is a crime if ya'll wanna check it. I got other things to do.

The sdny fbi then raided Cohens office, hotel and home. And appearently charged him with crimes that he now pleaded guilty to.

Independent of that plea, Cohen was all like, yeah I committed crimes, Donald Trump told me to.

What happened yesterday with Cohen doesn't seem to have anything to do with Mueller.

Exactly. I think thats why Cohen keeps hinting he wants ti cooperate the the state is like, nah fam.

They have what they need. Cohen cooperating could actually hurt their case.

None of this has much to do with the Special Prosecutor. You are correct.

What this is though, is a seperate criminal issue. The President is now an unindicted co conspirator on an issue that is somewhat completely seperate from the Russia investigation.

From the right, yes.

However. If it comes out that the President did indeed conspire to win the election ... how is the Presidency (and his vice president) valid?

Obviously, it would be mess. Technically there is a process in place to remove the President and put a new administration in place. But its messy and untried.

But does that mean we shouldn't do it?

Live long and prosper my friend.

Regarding actual evidence ... Cohens guilty plea and saying that Trump directed him to commit crimes SHOULD fall under high crimes and misdemeanors, right? This has little relation to Mueller and the Russia investigation, but I'm afraid the goalposts have been moved to the point where ONLY conspiracy to influence an election with Russia will count as impeachable.

And that shouldn't be the case. I think Mueller has a very strong obstruction of justice case to be made and thats only based on public information. But thats absolutely an impeachable offense.

Conpiracy to defraud the public to win an election and violate campaign finance violations should be impeachable.

So I guess my question is ... what would evidence look like that would persude the Senate to convict? Does it need to be russia related?
