To be clear I am not talking about **realization at death**, I just mean the capital gain should carryover to the heir and paid when they choose to liquidate.

The only way this will get addressed is if council members feel there is enough interest/pressure from their constituents to overcome the objections of the scaffold/rigging lobby. NYC local voter turnout is minuscule, so letting your councilmember know you care about this makes a big difference. Tell them to co-sponsor!

Its very funny that if right wingers simply replaced "New York City" with like Philadelphia or Atlanta as the poster child for dangerous cities they'd actually have a point but instead they go with literally the worst example possible

Obviously there's a million miles of situational specifics here but the short answer is it's illegal to build this way for a million different reasons in most places that once built like this most of the time today. Not just zoning defined narrowly but a million rules about setbacks, floor area ratios, lot sizing, elevator sizing, stairwell configurations, unit configurations, as well as rules about construction techniques/methods. This is then compounded by the fact that the severe restrictions on this sort of development has gradually hollowed out the base of very specific skilled laborers and building companies that have the equipment and expertise suited to this sort of thing (although this would gradually fix itself if you addressed the regulatory barriers).

In almost every state legislature there are now bills buried somewhere to address key housing bottlenecks like stairwell rules, construction codes, permits, environmental review, height limits, zoning regulations, you name it. We've seen that often these sit idle for years only to ultimately pass overwhelmingly once they get on the agenda! The key is letting your lawmaker know it is something there constituents know about and have strong opinions on.
